I would just like to sympathise with you and say what a horrible man that man from the Debt collection agency sounds.
Personally I would just let him take you to court and let the judge decide how much you can afford to pay or not. Provided you are paying something, then they can't make you pay off everything at once and in any case they can't get blood out of a stone.
The agency will say in their defence that by not paying this month's £5 you have broken your side of the agreement. But I would send them the £5 and continue paying the £5 until you hear otherwise from the court.
I think this man is trying to frighten you and some of the things he's saying he's just making up. Go to the CAB and get their backing and prepare your case so you can put your side of the argument should it ever go to court.
Don't be intimidated by these people - or that man to be more precise!
Try to calm down and don't worry - easier said than done. Someone on here will help you. You are not alone.

you are part of 99% of the population of this country in owing money - this guy had no right to shout at you the way he did, as jericho sed i hope you got his name so u can make a formal complaint, its totally out of order - they wont take you to court as it will cost them more in legal ffes than the actual amount u owe the, my advice would be sit tight until you start ur job then phone them with the new payment arrangement YOU have come to. hope this helps n keep us posted xxx:cool:

Don't worry about bailiffs it would have to go to court 1st and a bailiff has to get in 1st so don't leave doors or windows open and don't invite anyone in. Ignore these tosspots, keep paying your £5 and tell the CAB whats going on as they often do reports about w*nk*rs like these in order to help others who are in the same situation.Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)0

I know its difficult but dont let them get you down! It is his job to make you emotional in the hope that you borrow to pay the debt back. All he is thinking about is his Paycheck and bonus. He would have to be sadistic to enjoy speaking to someone like.
You are perfectly reasonable and what he has told you about county court is complete tosh. If you can show the judge your income/expenditure and the efforts you have gone to wit hte CAB to make attempts of repayment then this will go in your favour.
I would personally telephone and ask to speak to the manager and make a complaint and also tell them you will reporting them to the OFT.
Make sure you make the £5 even if they say it cannot be accepted. They will not be able to refuse your payment and it will go in your favour.
If you dont wish to telephone them again have you got a relative or friend who could deal with these scum on your behalf? I personally now love dealing with these people as they dont like it when they realise you know your rights. Hell, If I had permission I would love to speak to debt collectors on other peoples behalfs as its totally wrong that they treat people like this
Chin up girl, you will get there and remember that they are your creditor, not your judge. I think some of these guys have a god complex!

I would investigate what happend to the standing order could just be a bank holiday delay anyway you need to see if it was paid or not and why not if not.
If it turns out they had the payment you need to write asking them to refund the charge they put on and for a written apology.
But they are certainly not worth your tears, you did well to keep cool.0 -

I know i owe them money and i know im in the wrong but i really dont think i deserved to be spoken to like that especially when i said i could certainly increase the first week of october. They cannot send the Bailiffs in as they would need first take you to court for a CCJ and then you would have had to broke the terms of the CCJ so now I know this guy is full of BS. Dont panic!

Also if its a debt collector I dont think he has any legal right to add 8% to the bill and im pretty certain you can threraten to take them to court. Then I suggest you contact the Trading Standards Office.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
