You stop any liability for debt collector fees by making it plain to the operator you do not believe any debt is owed. The operator can then disagree with you and try and use the court to rule on the matter, but cannot add fictitious debt collection charges

Something like (as well as the other stuff)

    Dear Operator,

I disagree with the assessors decision (reasons here, including the missing signage). The debt is therefore denied and debt collection is not appropriate. I am willing to continue to use alternative debt resolution to attempt to settle the matter, and suggest the Consumer Ombudsman.

Failing that, I suggest we use the courts without delay and without artificially incurring costs. Please follow practice directions to state
your claim. I will then reply and we can then narrow the issues before any action.

HooHoo, agree and normally it would be good but I think maybe Wendy is not up to this yet.

As she parked and shopped at One Shop who clearly show a sign with no penalty displayed otherwise, the first point will be to discover if the PPC had the rights to do so and were they given permission on behalf of One Stop.

One would have thought that together with the One Shop sign would be the PPC sign.
This is a question to be asked of the CEO of One Stop.
As it is happening with others, the PPC's are trying this extort money where they are not permitted to go

The IAS just admitted that the sign isn't readable, or to code.

This should never make it to court, because it's a total laughing stock.

Fire off a complaint to Trading Standards and your MP.

But they have said that it is readable close up

The One Stop sign wasnt that far away from the Parking Peoples signs. But I didnt even look at their signs as the One Stop Sign said it all and was clear enough to me. It says that I can part there because im a customer . One Stop have since taken down the signs.

That is my point. They said that the text isn't large, and that it's readable close up. It must be readable from far away. They've completely contradicted their own Code Of Practice.

Which they have to; they promise to reject 80% of appeals.

    They say, "

... and whilst the text is not large it would clearly be capable of being read at close distance.

The implication therefore is that the text is small (opposite of large) and therefore cannot be read at medium or long distance from a car being driven into the car park. If the text was large enough to read from a moving car they would have said so. In other words, they have admitted the signs are inadequate.

But close up to where, in a general car park or the private land that One Stop CLAIM is theirs. Is the PPC sign easily seen in the One Stop area

Exactly. If the sign was adequate they'd have said as much, something like "I find the sign to be within the specifications and perfectly readable", but they've said that the sign is too small to be read from a distance. Probably got sacked over such an admission, too.

    Many thanks.

How can you determine which are fake and which are not.

How can I find out what the court case fees will be and what these debt collectors including CPM might end up charging me?

Any debt collection attempts in the absence of a court decision in their favour can safely be treated as fake/scare-tactics.

You would only get a genuine debt collector on the case if it did actually go to court, you lost your case and failed to pay the judgement within the specified time - And its unlikely you would let it get that far even in the very worst eventuality.

The PPCs who use the IAS seem to do their very best to avoid testing its often very shaky and questionable deliberations in a real court! :)

The One Stop sign was on the side of One Stop Shop, along with the private parking companies sign. The private parking company also have signs along a wall where other cars are parked, which I believed to be a sign for private parking - where the cars were.

Since then, further along there is a sign which is above your head.

Says this at the end of the thread:

PCN in a private car park in England/Wales? DON'T PAY IT BUT DO NOT IGNORE IT

USE THE 'FORUM JUMP' ON RIGHT, GO TO THE PARKING TICKETS FORUM. READ THE 'NEWBIES' THREAD.
Do NOT read old advice to ignore, unless in Scotland/NI.

Dont pay, but do not ignore....

Isnt that conflicting what all have said about ignoring the debt collector letters?
