    The most incompetent regulators in our country. I don't see why is this different from banking when in the same situations customers have far more protection and have just to report fraud to get a refund.

    Mate ive tried alot of times, Ive had advisors knowing whats going on then ive had advisors that just want to say its down to me. Ive given up i dont know what to do, Im told il be contacted im told itll be sorted but it isnt, I dont know who to turn to anymore

    OP - try the Vodafone online forum on their website, if you don't get anywhere try reporting it to http://www.phonepayplus.org.uk

    And get Vodafone to put a premium rate bar on your phone, this will stop incomeing and outgoing premium rate. Ask on the forum, their CS on the phone denied all knowledge of a bar when I asked them but it does exist.

    They said a bar was placed but they still wont accept liability

    Okay so now im really stuck

    Payphoneplus sent me the following Email :

I write to advise you that prior to receiving your complaint, PhonepayPlus has undertaken a review of the service including assessing consumer complaints received and intelligence gathered through internal monitoring and research. Having considered the information gathered PhonepayPlus, in line with the rules and regulations set out by us, concluded that it did not have sufficient evidence of non-compliance at that time. Accordingly, PhonepayPlus has allocated this service to what we refer to as a “Service review”. This means that the service will be periodically reviewed to ensure that we are still happy with the assessment that was made and to determine whether any issues of non-compliance have arisen. Therefore it is our decision that no further regulatory action will be taken at this stage .
    If new evidence comes to light or should the service require further investigation at a later date PhonepayPlus may revisit your complaint. If there is any additional and new information relevant to the case that you would like to share with PhonepayPlus please contact us.
    The decision to close your complaint does not affect your consumer rights. In this instance, you may wish to contact the provider of the service to discuss the possibility of a refund.

    Vodafone have placed me in deadlock

    The ombudsman says they cannot deal with this

    So how the hell do i get my £360 back?

    I'd start a Small Claims Court procedure against Vodafone. They are collecting the payments. Let them prove that these payments were authorised.

    How would i go about taking them to small claims court? Will it be expensive?

    Until you establish who to sue and their basic details you can't sue anyone. Once past that problem you'd have to prove the money was taken without contracting to the service. Dubious Gambling sites are often based off-shore anyway, making it difficult to sue.

    You'd do far better to contact the Web Relations Team following the instructions on the main Vodafone thread (near the top of the Mobiles forum page) and having a try at phonepayplus as others have mentioned.

    That's why I suggested suing Voda, but don't take my word for this.
    Once past that problem you'd have to prove the money was taken without contracting to the service.
    Surely it's the other part that has to prove that the customer did contract to the service.
    You'd do far better ...having a try at phonepayplus as others have mentioned.
    Useless Payphoneplus has already washed his hands - see the post above. That said, their reply looks like as blatant fobbing off without even addressing the particular case. It's possibly worth trying to escalate the complaint there to someone more competent.

    If you read above phonepayplus decided there was no foul play and wasnt really intrested. The company in question is based in china from what i can see and vodafone still dont want to accept liability.

    So i dont have a bloody clue where to go. Ive posted on consumer advice forums also i will not let this go.

    Not sure I would sue Vodafone in this situation. I'd want some legal advice first - I have a free help line on my hone insurance for that much, at least. Unless I was certain I had a case against Vodafone it wouldn't help matters. After Vodafone have informed you that they have reached deadlock I'm not sure the WRT could help either. As the Ombudsman have washed their hands of it that just leaves whatever you can do about Phonepayplus, if anything.
