    trouble with that is it would be hard to make it not sound like telling them off when their not deliberatly being noisey. Which very well may make em be noisier, check the lease and get a carpet in the house above ... buy em a rug maybe?

    You can complain to the enviromental health department of your local council about the noise from your neighbours whether they live in the same building or not and by law, Envirnoment Protection Act 1990, they have to take action.

    This is most likely to be a letter to the people in the flat informing them that a noise complaint has been made about them. It will also be regarded as an official complaint about the neighbours.

    However it's probably better to complain to the other flat owner in writing (as he is absent) and inform him if he doesn't rectify the situation within a certain time period i.e. carpet the floor , you will be complaining to both the freeholder about the breach of section xxx of the lease, and the enviromental health department about noise pollution.

    You are suppose to keep a log of the noise for the envirnomental health department.
    I'm not cynical I'm realistic :p

    I would be very surprised if your mother's lease -
    The OP's mother owns her flat, it says so quite clearly.

    ...and all flats have leases relating to the freehold of the property they're in. That's why you can't have a freehold flat (unless the flat is the entire building). :)

    Even if I had misread the first post, however, I don't think there's any need to make the comment: "it says so quite clearly". My post was constructive and intended to be helpful, so no need to leap on a little point with such sarcasm! :)

    Hope your mum gets it sorted, OP.
