Sim only deal, cancelled but charged whole month?

Hi guys,

Recently signed in for a talkmobile sim only plan.
The plan seemed atractive: 4GB data, 3K minutes, 5K texts.

I called them up a week later to cancel the service as coverage was rather patchy with calls breaking.

They are now charging me 9.95+VAT. I assumed that if I cancelled during the first two weeks I would only be charged for the days used? Also 9.95+VAT is about £12, their page clearly says £10 a month and they confirmed that on an SMS.

    B. This Agreement is for the Minimum Period shown on the order form or in the Welcome Note. It starts when Talkmobile connects my SIM Card to the Plan shown and I may end it by giving Talkmobile 30 days' written notice.
    If you give a notice after a week you pay for about 5 weeks.

    You can try arguing that according to the CCR (former Distance Selling Regulations) you can cancel within the first two weeks without any extra charges on the top of the actual usage

    CCR indeed, I cancelled a EE aim only 4 days in as the signal was crap, no charges.
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    1. You can cancel your contract at any time – just give us 30 days’ notice that you intend to leave us.
    2. If you cancel within 14 days of taking out the contract, then that's considered a 'cooling off' period and you can cancel without a cancellation fee, providing you haven't exceeded the allowances of your contract.
    3. If you cancel after the initial 14 days but before the end of your contract, you'll usually have to pay off any time left on your agreement.

    Thats poorly written because it states (monthly) allowances which are not done in 14 days but monthly, albeit in works in the consumers protection by not enforcing pro-rata billing.

  • Update: They issued the bill but issued a credit on the system a few days later, so all cancelled.
