NTK issued outside 14 days

Hi, I've just received a NTK through the post (no ticket issued on the vehicle) Issued 25.01.16 for a missed parking charge on the 06.12.15. Can I dispute it simply because it has arrived outside of the 14 days stated in the Protection Of Freedoms Act 2012? I've read conflicting advice and would like someone to clarify it please. Thanks everyone, advice on here is fantastic :-)

  • Thanks for replying, I've read through most of the related info & most people seem to agree that if not issued within the 14(15) day period then it's not valid but I read a couple of posts disagreeing with that & want to be 100% when I appeal.

    What PG is suggesting is read the Newbies thread - I can highly recommend, lots of good info and most importantly up to date. You'll learn a lot as I did as a Newbie a year or so ago.

    Important stuff initially is NEVER phone private parking company. Do not say who was driving.

    Info the experts will be asking is which PPC? is it definitely an ANPR ticket?

  • Thanks bluetoffee1878, much appreciated. I'm totally new to this so reading as much as I can but finding a lot of it confusing lol. I've read all the newbie stuff & to me it looks like because it was issued outside the 14 day period then it doesn't hold water anyway so that would be the easiest way of dealing with it. If not I will go down the route of an unfair charge. It's a company called 'Park With Ease' (That's a joke in itself!!) It must be an ANPR ticket I think we went to the site to visit a market, didn't have change for the parking so figured we'd get the ticket on the way out as last time we visited they just had a barrier to put your ticket in to leave so we thought we wouldn't forget as we couldn't leave without it lol. We forgot & they clearly have removed the barrier. It's a £1.00 charge & there was only about 10 cars in the huge car park so there loss was exactly £1.00 which I'm happy to pay but the letter is demanding £50 reduced to £25 if I pay within 14 days.

    Is it a NtK or a follow up? Some wording may help.

    Clearly a rejection under POFA if an NtK, but make sure it isn't a letter chasing up a previous NtK (that they may not actually have sent.)

    There is no appeal worth trying. Hate to say it but £25 might be an option...

    perhaps they issued an NTD at the time ? (windscreen ticket)

    if this is the case, then its inside the timelines for POFA2012 where a windscreen ticket was issued (even if one was not found)

    ie:- the NTK would then arrive between day 29 and day 56 which seems more likely to me

    so appeal as if this happened, but check if it has photos on the day of the car in situ or if the pics are ANPR pics of the entrance and exit instead

    the NEWBIES sticky thread does answer all your questions, but there is no simple description we can tell people as the issues are too complicated and diverse

    plus they may not even be following POFA2012 and keeper liability (they would use the IAS and IPC option of ASSUMING the keeper and driver are one and the same)
  • Thanks everyone :-) The top of the letter states PARKING CHARGE - NOTICE TO KEEPER. There is no reference to a windscreen ticket being issued or any previous letter being sent.
    Coupon mad thanks for the info - be gutted if that's the case but appreciate your input. Is it not worth appealing under unfair charges as legitimately their only loss was £1.00 I forgot to put in the machine.
