  • I guess I was giving the OP the benefit of the doubt but the advise I've given would make it clear that it needs to be declared (which the OP states they have done) then it is up to the insurance company what they do. The insurance company has advised him it'll be added at renewal. I see no reason to say that the insurance company has misadvised the OP.

    There is no statement from the OP he disclosed his pending conviction.


    The only way he is in the clear over this is if the question he answered when buying the policy did not ask about "pending" convictions.

    When does a "pending" conviction cease to exist? Presumably you mean that if you haven't yet attended a speed awareness course but you're scheduled to do so, you still have a pending conviction?

    This thread isn't about speed awareness courses. It looks like the OP's offence was driving without third party insurance cover


    A "pending" conviction ceases to exist when the alleged offence has been dealt with.


    The OP's pending conviction for driving without insurance looks to have been dealt with by way of a fine and points (But we can't be sure)

    There is the hint that the OP bought the insurance following getting his previously uninsured van freed from the police.


    And that his insurer wants to know why they weren't told about this when he took out the policy.

  • Over the phone, the question my company asks is 'have you in the last 5 years had any driving licence endorsements, fixed penalty notices, been disqualified from driving or do you have any PENDING prosecutions'. Basically, you declared the points when you got the letter through, but I think the insurer is saying that when you took out the car insurance, they would have expected you to say you had a pending IN10 for driving with no insurance.

    Apology to the newbie OP would make more sense as you have managed to post misleading advice to him when in fact he needed to be aware of the seriousness of the situation he may face over this.


    He has probably got fed up with the tennis match that ensued arguing over what now turns out to be your "misreading" of the OP and departed!


    Maybe you can now edit your misleading posts?

    I believe GingerBob was referring to Admiral asking about driver awareness courses (the bit he put in bold) not pending convictions
