So the overpayment is about 16 weeks benefit? So roughly how much? If it's fairly small then it's unlikely to even make it to a criminal investigation.

You may find you get a civil penalty for reporting the change late. Either way, 4 months CA is not enough to land you in court.

    Stop worrying.
  • I estimate it to be about 1300-1400
I have already contacted to try and repay but the debt recovery say they havent been notified of the overpayment yet so I have left my details to contact me as soon as they are notified.

What exactly is worrying you - finding the money to pay them back or that you might be hauled over the coals? If it's the latter I really think you are over-reacting. It's a few months of overpayments, not a few years. You've made all the right moves to put things right so I really don't think they'll bother to take things any further - it's too minor.

You're really overthinking this whole thing and worrying will change nothing. You've done all you can. A simple repayment plan will be DWP's only dealing on this matter.

  • I have had yet another sleepless night about it. You are right that worrying will not change anything but it would be nice to know what happens at this point. Do I just wait for a letter asking me for more info like wage slips etc? Or do Ijust get a letter to say how much to pay back and how?

In your first post you stated that you would be contacted to sort out arrangements to pay the over payments back.

You really are overthinking this and it will not do you any good.

You owe them approximately 18 weeks at £62.10 per week? £1120 or thereabouts, during my many roles with the DWP one of them was as a Debt Manager, I dealt with arrears of over £20,000 most times, they were not taken to court as a norm, they were contacted and asked to settle the debt within a two year period (this was the debt steer at the time) no one is going to do anything other than contact you to arrange for you to pay it back.
  • I have worked it out to be 1304.10.
I have posted all my wage slips etc today so I guess now I just wait for the letter to come to say how to pay it back?

She said this morning that I may get a fine for reporting it late to them. I dont know if you know anything about those? How much it would be?

Did they ask for wage slips at this point?

  • Yes she said that is the only way they can work out the overpayment is to see what my wages have been and to post them to them. Does that sound right?
