The alternative is for him to do the driving awareness course and say it was him, but if he says he was driving will they somehow find out he wasn't, then I'm sure we'll be a in a lot more trouble.0

There is no point her confessing to her insurer she has been driving a hire car uninsured!
If she wants independent confirmation that she cannot drive hire cars with her driving other cars cover she can read what it says on her motor insurance certificate!
She wouldn't be 'confessing' anything! She would be asking whether or not she has cover - it could easily be for a future hire.
Yep, of course she could read her policy. A bit like newbies reading the NEWBIES sticky! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

NOT bad advice
The lady does not know what the picture shows. The police will already know the car is insured by her partner and normally the police will act on that, but they want to know who the driver is rather suggesting they know more than they are saying.
As you will see below, she needs to check with her insurance company about the terms of her third party.
Big difference picking up speeding points to a criminal charge of no insurance. So yes she needs to chat with them first, my advice stands
Your bad advice included telling her she might be able to use driving other cars cover for a hire car!
How will the police know her partner is insured to drive it?
He has been asked for details in relation to the speeding offence only
No insurance and a speeding offence are both the same of offence!
Both normally dealt with by fixed penalty + points.
But no need to discuss insurance at all with the police!!0 -

100% right Nigel, whatever happens there will be a fine to pay and points, the problem is the question the police are asking ?
"who was driving"
Hence a catch 22 situation which will favour the police either way so much better to be honest from the start.
It does not follow they will take action from the insurance point0 -
Yep, of course she could read her policy. A bit like newbies reading the NEWBIES sticky!
Not her policy.
Her certificate of insurance (one piece of paper!).
Which clearly states you cannot use driving other cars cover for hire cars. End of story. (Everyone's is the same)
Using her driving other cars cover is a total red herring she has seized on provided by a poster who is ignorant of the situation regarding DOC and hire cars.0 -

You are doing it wrong yet again. I never said
"Your bad advice included telling her she could use driving other cars cover for a hire car!"
I asked her if she had her own insurance policy with third party
A QUESTION.
My insurance policy includes third party for any car
You do it your way ..... no problem ?0 -
My insurance policy includes third party for any car
Lucky for you came and revealed your ignorance before you went off in an un insured hire car and maimed someone
Have a read on what you are allowed to drive under your driving other cars cover as stated on your certificate.
Then have the decency to stand corrected0 -

At the moment - this is the best advice you will get, he names you, you confirm and take the course (or fine/points).
Insurance issues are often not checked on standard speeding offences unless you raise suspicion or prove difficult. If it is, you probably have no defence at all, so cross your fingers.0
