Wow, I wasn't aware of that (Annex A doesn't exist any more). This slightly complicate things as Annex A set out nicely all the details the claimant should provide. Also, the newbies and LBCCC threads should be updated to warn people about the changes. I was following these threads, and I have a feeling I did this for nothing right now...not criticizing by any means. Just pointing out that this advice is now slightly out of date and it should be mentioned on top of these topics.
What? Why so despondent? It's merely that you need to look at the current practice direction. Things change a bit so always look at the latest version of anything mentioned here.
The NEWBIES thread is up to date because it was edited just days ago and doesn't mention the practice direction anyway.
The OP of the 'LBCCC Fightback' thread was unable to return as a regular poster here and it was written a while back, so she can't update it now unless she pops back, but the gist of the advice is the same. Are their letters still not compliant with practice direction tho? I am by no means a solicitor, and reading this well... I am unsure, put it this way.
I know there is a problem with the client, they say their client is ZZPS, and they can't go to court on behalf of them as I "owe" money to Excell, am I right?
I will certainly have a read through new practice direction. I guess I don't have to read through protocols that are irrelevant to this case, like "personal injury protocol" etc?

So I have sent them a letter I posted above. I did send it to 3 different senior associates I have found on their website. I think they still have forwarded them to ZZPS as I got only 1 response, which looks like a template letter. Again, this response didn't address any of the issues I have raised.
I am at the stage where I am not going to play ping-pong with them any more. I am now going to complain to SRA. I sm planning to send one last letter to Wright Hassall with the content described below, do you think it is a good idea?
Content of the letter I am planning to send to Wright Hassall:
- inform them that I have now complained to SRA
- point out that they are so incompetent they do not seem to know the law (claiming to comply with Annex A and B of Practice Direction despite the fact these are not part of Practice Direction after the change in April 2015)
- state that by claiming their client is ZZPS they didn't comply with Practice Direction. They can't represent ZZPS in court and they are required to tell me who they will represent should they decide to go to court,
- they further didn't comply with Practice Direction para 6 point A stating that if the claimant wants money from the defendant, they have to provide a calculation for the amount of money claimed. They didn't provide such calculation,
- claiming the CCJ could be obtained at this stage is not true and probably used to bully or threaten the claimant into paying,
- state that I will not acknowledge any further correspondence

Concentrate you attack on WH. Make them spend money defending their actions. Post their letter up here for us to pick to pieces. The more money we can cost them the less eager they will be to stay in bed with these scammers.
With regard to court, do you have an anonymous rejection from an IAS adjudicator? If so, get it in front of a judge. Ask him to call the writer to court where he can be questioned about his, no doubt, ill-considered and perverse decision. The IAS/Gladstones/IPC will not like that at all,You never know how far you can go until you go too far.0 -

I didn't go to IAS. I asked for POPLA but they refused providing me with IAS number. I didn't appeal there as the general opinion is that it's not worth it.
I would post letters from WH here, but I have a dozen of them now (we had quite a chat over last few months).
By the way, how much time they have to start court proceedings since the PCN date? Is there a time limit at all? Or a time limit after which they have to send me LBC again? Cheers.0
