Samsung s6 edge case issue

I purchased a Samsung s6 edge on the 24th October. My partner at the time also bought me a Samsung Clear View screen. The screen has since caused scratches to my phone which after googling I have discovered is a problem Samsung are aware of. They have offered to have the phone inspected and screens replaced if the cover was found to be at fault.
Only problem is, I only have the receipt for the phone itself and not the case as it was a present from someone I am no longer in touch with.

I have emailed Samsung about this and they refuse to do anything without both receipts.

I have looked at the Consumer act and the guidelines for products not fit for use are clear and can be exchanged without a receipt....however I can't find clarity on what the law would be on damaged that has been caused to another object (my phone) by the product not fit for purpose (the case).

Can anyone point me to anything that can clarify the law on this? I don't want to get into a battle about this if I have no leg to stand on.

    You don't specifically need a receipt for faulty items, but you do need proof of purchase.

    If you genuinely can't get in touch with this person to get hold of the receipt or similar, I think your chances of a resolution are quite slim.

    Yeah unfortunately I don't really want to contact my ex over a receipt that he probably never saved in the first place. No other proof of purchase either...so as I feared really.

    Although I was pretty sure the consumer act said that with proof of purchase you can get a refund, without a proof of purchase and under 6 months you can get an exchange but not entitled to a refund.....

    The 6 months is regarding the burden of proof around any fault. From the MSE Consumer Rights page:
    When goods are faulty, if you return them within six months, then it's up to the shop to prove they weren't faulty when you bought them. After this, the burden of proof shifts and it's up to you to prove they were faulty when you bought them.
    And regarding proof of purchase:
    With faulty goods, you simply need to prove purchase. This could be the receipt, but any other legitimate record - such as a bank statement - should be fine.


    Have you tried getting in contact with the retailer to see if they can help you in any way? Your consumer rights are with them rather than the manufacturer.
  • Ahh I see! Thank you that's really helpful....I'm not too clever and find all this stuff a bit of a minefield! I will try going back to carphome warehouse and see what they can do :-)
