Returned Item/Open Box

If there isn't anything actually wrong with it (not that I've tested it yet) tho am I within my rights to ask for an exchange.
My view is:
(1) You have a right to ask for an exchange, but that the company is not obliged to agree to your request.
(2) You do have a right to demand your money back (including return postage) as the item was not as described (it was not brand new as it was previously sold as new to another retail customer).
Given the second point, I would expect the company is likely to agree to your request for an exchange if they have a brand new item in stock (in order not to lose a sale).
PS If you return the item take a note of its serial number and photograph it and the box showing it was a previously returned item. In the unlikely event they resend the same monitor, rather than a replacement, then you can again return it as you will have good evidence it was a returned item.0 -
You can ask for an exchange, but if you exchange it they may insist on your sending the original back first, in which case there is nothing to stop them re-sending it out to you anyway.0

I will ask them and see what they say... I have already photos of the box which it came in as it is absolutely battered, have yet to check the monitor to make sure its ok. This whole thread might be pointless if its damaged or faulty as I'll be sending it straight back.0 -
