Returned Item/Open Box

Just looking for a bit of advice.

Bought a couple of reasonably expensive computer monitors (£850 each) online. On receiving them one of them is blatantly a customer return (the box still has their returns label back to the company on).

I know in the past when I've bought from other companies they reduce the price slightly for customer returns/open box products, and they clearly state this on their sites and in the description.

The company who I purchased the monitors from sold them as brand new.

Where do I stand on this?

    Are you a consumer, or did you make this purchase as a business?

    If you are a consumer, then you can return the goods for a full refund.

    If you are a business purchaser, then you will need to understand the terms of your contract.

    I know I can return it for a full refund, but I would then need to purchase another one, and there would be a chance that they would just send me the same one again

    Then what do you want?

    You haven't said, but I can guess that maybe you want the monitor supplied at a reduced price?

    That is a possible remedy - subject to negotiation.

    The seller can of course refuse and recover the goods - at their cost, as they don't conform to contract - and refund you.

    Then return it for a refund and buy elsewhere if you think this retailer will send you the same one again.

    Wow, £850 each? what size/make/model are they?

    Back in the late 80s I was selling DTP monitors at £4k+ each with "high" resolutions lower than your average smartphone nowadays, but I can't think of any "computer" monitor now outside of broadcast "reference" monitors that comes anywhere near that sort of figure! Ok, so I have some 80" 4K resolution retail units on the books currently at £5K+ but "computer" monitors at £850?

    They're Dell 30" U3014 monitors, they're great for doing post production work and 3D.

    If there isn't anything actually wrong with it (not that I've tested it yet) tho am I within my rights to ask for an exchange.

    When I said I was worried that they would send the same one again I meant if I had returned it for a refund and then placed another order.
