My partner's house has been let without his knowledge or consent-ombudsman won't help

    Personally I would report this to the mortgage lender as not having consent and the HMRC as Maui not be declaring it.

    Wow OK, there are a couple of unnecessary and not accurate replies to this.

    Firstly, I am not a bitter jealous ex. If the post had been read correctly, I'm posting on behalf of my current partner.

    Secondly, thank you to those who have offered help and advice without commenting on things that have not been raised in the original post and have not made assumptions based on the fact that there is a divorce involved so my partner therefore must be trying to get involved in a pointless spiteful battle to the death. He is trying to stop it from happening again and dragging out a divorce that should be quick and clean. He's paid his solicitor, he wants the house and her gone- which is going to be a damn sight harder if her and her dodgy agency are allowed to continue getting away wth what they are doing with property that is legally half his that they are limiting his rights to against his will.

    Again, thank you to those who have offered constructive advice, I and my partner are very grateful. He will be going back to the solicitor on Monday who has kindly agreed to look at the situation as the house is a divorce asset. He's already said before that the agency has clearly acted against protocol.

    What is the value of the house? What is the outstanding mortgage? How much would it cost for the ex wife to be to buy him out?

    What other assests of the marriage are there? When the whole picture is looked at is it worth paying thousands to lawyers to sort out or can they go to mediation to agree a settlement?

    He's only paid £750 to the solicitor for the whole thing- she doesn't have a solicitor. The idea is that its the only asset so should be sold and divided with the divorce as is standard if she won't buy him out. His concern is that she is going to repeatedly lease the house without his consent as and hold up the divorce as her and the agency have gotten away with it this time and will be able to get away with it again. He just wants to find a way to stop it happening again and get the divorce done nd the house gone ASAP without anymore issues thrown in.

    Can she afford to pay him half of the value of the house without selling it, perhaps through a mortgage?
    Are there sufficient other assets of the marriage to offset half of the value of the house?

    Then you'll need to force the sale of the property through the courts if necessary. Threatening such action may focus the ex to consult a solicitor. Reality may then sink in. Puss_y footing around will get you nowhere. Go for the jugular.

    Is she interested in buying the property?. A letting agent with the help of a letting agency can easily find and manage tenants. Has this been done to devalue the property when it is sold to benefit the buyer?.

    She won't comment on it. She refused to respond to the solicitor's letter giving her that option. She isn't a fan of parting with her own money so he doesn't think it is likely. There are no other assets, just the house.

    He isn't sure. She did this shorty after a disagreement between them some months ago and it appears she did it just to cause trouble and wrangle back control in her favour. Whether or not she has considered that it could work in her favour as a buyer is something we just don't know.

    The other option he has considered is moving into the house while it is being sold as soon as the tenants leave- but he has tried this before and she threatened to move in with him if he did.

    He can tell her he's going to inform the mortgage company and the HMRC for undeclared income.
    That'll proably focus her mind a bit more.
