Can landlord insist I move out at a certain time?

    Even more so when you date them on the day you leave, but the agent cannot access until the earliest the next day.

    If the tenant fails to vacate by the end of the tenancy, then a periodic tenancy arises and tenant is liable for rent for a further period, till that tenancy is ended.

    In this case, it seems to be midnight, so not an issue, but some tenancies run from midday to midday.

    If the tenancy ran from midday to midday and the tenancy started on a particular date such as let's say the 22nd then the tenancy will finish on the 22nd at 11:59:59 AM in the morning and not the day before.

    I would think something as important as that will be in the tenancy agreement.

    Update. Grr, they're so annoying. The earliest our cleaner can come is 2pm and has arranged to bring additional staff so will be finished by 3:30. Last week, we were offered 3:30 and when I asked whether that was the latest possible time, the agent then brought it forward to 3pm. I can't agree to that appointment as the contract is very clear that if we're not ready to check out at the agreed time then we have to pay for the check-out clerk to visit at a later date.

    No-one is answering the phone at the agent, so I've asked her to arrange an appointment for 3:30 or later. If she can't do that then I've asked her where we should drop the keys tomorrow and to arrange a checkout for the following morning. I did also say that I've read the agreement carefully and am sure we will not be in breach, but if she thought that we were to let me know which clause we'd be breaking. I'm hoping that might do it. I have so much packing to do - I don't need this right now!

    Can't they do the checkout while the cleaners are there finishing off?
    At least if they raise an issue the cleaners can fix it.

    What sort of state is the place in that it needs a team to come clean it.

    What about splitting the cleaning get most of it done the day before and they come in to clean up after everything has been moved out.
  • I cant be the only one thinking that you werent allowed to move in till 4pm, now they are insisting you leave by 3pm. An hour for a quick check-over before moving more tenants in at 4pm?

    FGS stop communicating with them and just move out when you're ready (by 23:59:59)


    if they try charge you for a check out, just say you don't require one.

    It's sorted. They're coming at 3:30.

    The place is fine - we've had a cleaner fortnightly the whole time we've been here. But an end of tenancy clean is always longer (inside cupboards etc). Our cleaner does 3 hrs usually but we're asking her to do a bigger clean in an hour and a half so she needs someone to help. We'll help so should get it done.

    I'm just annoyed they were forcing us to work to a timetable that didn't work and were implying there were contractual obligations when there weren't. Funnily enough, when I asked her which specific agreement I'd be breaching, she agreed to 3:30.
