LBC to wrong address

    My worry is that I don't want to get to court as I am applying to mortgage soon and don't want to have CCJ.
    Getting to court won't affect your mortgage application.


    Only if you lose or ignore the court and end up with a CCJ that you do not pay off within 30 days will you have a CCJ on your credit record.


    (ie you can "go to court", and if you lose your mortgage is safe unless you refuse to pay within 30 days)

    is there a recognised time limit between a formal LBC and the time that court action should be started?


    or can someone send out a LBC and sit there for 5 yrs and 11 mths , hoping that the recipient has moved house?

    Technically yes but in reality it would be expected that having threatened to issue proceedings within 7/14/21 days that that would happened not too long afterwards.

    Don't forget that in this situation Gladstones are likely to be acting in a debt collector role only.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    are "Gladstone's" acting as a Debt collector (not as solicitor's) allowed to send a letter that is blatantly untrue and to the detriment or the OP?

    Parking ticket was in June.
    Gladstone letter sent in November.
    Nothing since then.
    I don't live in that address any more. I seems ridiculous for them to keep writing to me.
    I am sure that they had similar situation when someone moved home and did not respond to them.
    When will they feed up? Why don't they check if I still live there?

    they can only get the details (car VRN) once per incident from the DVLA , if they were a reputable company they would use a tracking Co to get your correct address before issuing a court summons


    however they are not reputable.

    If you ignore this you *could* end up with a default CCJ you don't hear about until it's on your credit record.

    You've said yours was a LBC. So follow the advice for LBCs from Gladstones which is what I posted to you before when I said 'read the links and search this forum for 'GLADSTONES' as a keyword. Shedloads of threads to learn from to learn what sort of robust response to make.'

    You should respond robustly and clearly state your new address so no letters or court papers go astray.
