Quite possibly NPE have never bothered to submit any evidence because they jumped ship from the BPA to the IPC and then changed their name to National Parking Enforcement. They were always fairly usless with any intelligent substance to their evidence packs but they did used to send them (but that was before the changed to the IPC). So it's anyone's guess whether they sent POPLA evidence in your case.

    Earlham House, or Dereham Rd?

Easy to beat and you've done everything you can at this stage as long as you followed the usual advice for a decent POPLA appeal back in October, as keeper, with the usual appeal points. You've told POPLA you haven't had any evidence. So, if they have, they can't now make a decision knowing you haven't. And if POPLA realise they've never had any evidence either you will soon win.

So, pitch black and no contract formed because the sign on the wall was illegible/unlit. A trap by NPE with a CCTV camera zoomed in on it. NOTHING like the Beavis case where a licence to park for free was offered and the charge after that was deemed justified under those circumstances. The usual 'penalty rule' which is engaged for a parking charge and can certainly render them unenforceable, was disengaged UNUSUALLY under those circumstances. Your case is nothing like that.

If evidence does show up, you will need to rebut it to focus the assessor's mind on unreadable signs in the dark/no contract and the difference between this nasty trap & fine set-up (deliberate cash cow with no legitimate purpose, merely designed to lurk, punish and charge a disproportionate penalty) and the Beavis case.

We'll help if evidence turns up. Quite possibly none was submitted as NPE have moved on to the IPC (but are probably still there at Dereham Rd, so boycott it).
