Parking charge notice ace security services

Hi all
Have read various posts in regards to ace security services and would like some advice on what to do next.
I recently moved and shortly after i parked to unload shopping as there were no spaces near by and received a parking charge notice from Ace security services which I paid straight away. After meeting other residents in the block of flats I was told by many that Ace security services are not a legitimate company and therefore if I was to receive another charge notice to ignore it. (As they had done plenty of times and heard no further from the company. One resident in particular parks their car there constantly) Beginning of December I then parked again to unload shopping, no longer than 30mins and came down to a charge notice. I therefore ignores it yet in the last few days have received a letter through the post from ace security services.!

Would like to know if the company is legitimate or not and if anyone could advise me on this matter.

    They were previously not legitimate but have now joined the IPC. Opinions may be that that makes them even more illegitimate than before, but now they can get your keeper details.

    Better pass the news round the other residents. It sonds like now it the time to band together and get them kicked out. Ticketing residents is not what good management is about.

    Thank you I am unsure whether to pay the full amount or to appeal against it all together as I was not there for long. I wouldnt mind if I had been there for hours and don't live here but to get a ticket for unloading my shopping I feel is unfair.

    you can choose to not pay them a penny, meaning they would have to try a court claim in the next 6 years

    all depends on any agreements you have , in your deeds , lease or with the MA of the development

    I can't seem to find out who owns the land, I'm thinking of appealing as I wasn't blocking any other vehicles for the short time I was there. And maybe see what they say. Ace security services do not check the land on a regular basis or routine. As there's a car parked out there constantly and their tickets are discarded in the bush or recycling as I can see that. But they have not had a ticket since before Christmas. If they were a legitimate company wouldn't they be checking everyday?

    who knows what their contract (if any ? ) says

    only them and the landowner or MA would know this, nobody else would

    you havent said if you are an owner or a tenant, but either way you should check the deeds or contracts you signed and see what the parking requirements upon you actually say (or dont say)

    this is your starting point for liability, knowing what rights, if any , you have to park on the private land, and what rules or covenants or similar restrictions are upon you when parking on this private land

    as its private land , somebody owns it, if that somebody or their agent has employed this PPC, then a contract has to exists (even if you cannot see it as its confidential)

    this same contracting owner or agent should have the power to decide if tickets can be enforced or not (or cancelled)

    you havent given us any of the above info, so until you do, you cannot be correctly advised on the situation

    the IPC and IAS are a waste of space, existing to protect their trade body and the parking companies signed up to them , so nobody is "on your side" - hence why you need to clarify your legal position (doesnt matter what others say, that is heresay, you need documentary evidence)

    I'm a tenant and rent a flat, which the land is on. I have looked through my tenancy agreement and nothing is said about parking on the land as there are garages there too. I have contact the estate agent to ask who owns the land and am still waiting for an answer from them a week on.
  • Email me a copy of their signage and I'll give you my option.

    Last time I helped someone Ace were taking the driver to court; they ended up paying vast amounts on their lawyer then dropped the case when I pointed out there was no case to answer.

    Perhaps they have fixed things since then, perhaps not.

  • The sign is ambiguous. It says

    no parking in the road

    and then

    if you park in this road you, the driver, accept that you will be issued with a charge of £100

    So is the charge for trespass, breach of contract or a contractual charge? It could be any of the 3.

    If it was trespass, then there is no case to answer, but who knows how a judge would interpret it. The Consumer Rights Act 1999 states they must interpret it in your favour, but judges can be capricious.

    There is no easy answer on this one - you could chose to ignore but they might take you to court. You might then win, but might not.

    Your lease might be key. If it says you have the right to park and nothing about parking restrictions then this will be a winning point. Otherwise, if you have a permit to park, this might also override the signage.

    Otherwise, the charge of £100 would not seem to be supported by Beavis. If the only people paying fines are the residents, what is the point?

    Not cut and dried though.
