Gas Safety Check 10 days overdue.

My Partner rents out a house.
Despite 3 appointments for the Gas Check, the Gas Safe Contractor has been unable to gain entry
How can he resolve this problem?

    I would have thought this was something for which the LL could give 24 hours notice and enter without the tenant's permission as the tenant appears to be preventing the LL meeting a legal obligation and it is very much a safety related thing

    Do you mean your partner is the tenant, or the landlord?
    If the latter, has he discussed this with the tenant?

    Pop a note in the door giving 24hrs notice, then return with contractor and keys. If the locks have been changed the call a lock smith. Withhold the cost from the deposit.

    Has the tenant had any say-so in when the engineer would be coming? I used to be phoned up and told it needed doing and I'd then phone their engineer to arrange a time convenient for me/him.

    It is for the landlord to arrange entry and to supervise this, not to expect the tenant to be there. (Some tenants will be but why should a tenant spend his time doing it, taking time off work etc etc).


    Re-arrange with partner going there himself, putting the request for the date/time in writing with at least 2 days notice. Do so 3 times if refused entry then apply to the court for access.

    What, for not being at the beck and call of the landlord who does not appear to be willing to take on his responsibilities??

    That really would be a "revenge eviction".

    They have had 3 appointments which have not been successful, the LL needs to carry out a safety check by law. If the T is being obstructive, then the LL needs to take action. Getting another T which is compliant, is not revenge.

    We do not know if T is obstructive: From the description given the 3 appointments could have been "gas man is coming round dd/mm/yy @ 10:45 be there" sent by TXT to the wrong 'phone number with 12 hours notice, and tenant is an Ambulance driver in his probationary period (ie can be fired if he doesn't turn up) on-shift. (Extreme I grant but hopefully you get the point..)

    Aqua, could you please give us a bit more background??

    The good news is the landlord is at least trying to get a certificate done....

    But the OP has given us so little information we can't make any assumptions - the LL might have just told the tenant "the engineer is coming round at 11" and assumed the tenant would be there to let them in.
