Small Claims Court Letters from UKPC

Hello All

I'd be super grateful for any advice that can be offered, as i cannot seem to find many threads relating to official court action with UKPC.

I got a single ticket in March last at my place of employment, on my first day at a new office , as i hadnt realised the car park was managed UKPC (this doesnt tie in with my employers values and isnt in place in any other location, its just we were renting a new space). My appeal wasnt upheld, and I have refused to pay. i was parked in a legitimate bay, it just didnt have a full white line around it.

I've ignored all letters to date, and on Friday recieved papers from the small claims court - so its geting more serious. I can pay up £255, admit part liability and offer a price im willing to pay, or deny and submit my defence. I have to act quite swiftly, but im not sure what to do! Ideally, I do not want to go to court as I'm certain to lose.

Do i offer £30 (im willing to pay that) or admit no liability and hope they drop the court case a few days before its due, as i've heard they have previously done?

i appreciate any thoughts!

You have to acknowledge the claim and file a defence. Otherwise you will lose by default.

After that, a long time passes.....

So then is the time you can negotiate with ukpc. They are hardly likely to accept £30 as they just forked out £25 to file a claim.

There are many reasons why you are not 'certain to lose', but if you do not put them in your defence you cannot raise them later.

Do i offer £30 (im willing to pay that)

Any offer is considered an admission so don't.

Go online and acknowledge service within 14 days of the date on the claim. Within 28 days of the date of the claim, put in your defence which should be comprehensive but not necessarily detailed. In your defence you will need to reference two key cases. ParkingEye v Beavis and ParkingEye v Somerfield. Both can help you.

Follow up with a Part 18 request to SCS for details of the contract between UKPC and the landowners, plus site plans, original pics of the car, copies of any ticket issued and any Notice to Keeper issued. Copies of signs they are relying on.

Are you sure these papers are from the court?

This wording ("pay up £255, admit part liability and offer a price I'm willing to pay") doesn't sound like a proper court claim.

Why are they asking for £255 AND an offer from you??

(Did you previously get a warning letter that you had a set period to pay after which they would take legal action?)

In short - have the papers come from the Northampton Court or are they on UKPC notepaper.

Does anyone here think that these totally discredited scammers would venture anywhere near a court? I certainly do not.

Like all the others think, it is a very strange thing for a court to do.
I wonder why they say admit part liability and then make an offer ?
What part of any liability do you think they want ?

Is it possible you can scan the letter. You will not be able to upload here but use say Photobucket to upload.

It's free and you need to create a quick account

Then if you post the link here but instead of using www, use xxx and a regular will make it live. As a new member, you cannot yet post the link yourself.

Remember to block out your personal details, everyone is interested to see this.

You are of course aware that UKPC are well known as fraudsters and the courts are well aware of this as is the DVLA

Young Deep, UKPC are stupid enough to do so

If the OP can upload the actual letter we can see

They filed 77 claims Jan-Jul 2015. None made it to the small claims track by July, which means one or other party caved in or there was a default judgment

Sorry, that was a summary in my own words! It is £255 or submit an offer if i accept part liability.

Yes, I did recieve a letter like this before Xmas instructing that I had 2 weeks. However, almost all oftheir letters over a 9 month period implied impending court action.
