Debt collection agency

Hi there,

I had a call from a debt collection agency (Moorcroft) today. They wouldn't speak to me because I would t confirm who I was.

Anyway, I did some digging and found that Southern Water sell debt to Moorcroft.

About a year ago, we moved out of our flat, and had a final meter reading and subsequent bill, which I paid in full. I have the details of this including the confirmation letter which they sent to my new address.

I had a text from my landlord saying that Southern had sent a letter to me to my old address, even though they had my new address details, as I'd recieved post before from them to my new address. I collected the letter and it said that I had a credit on my account of £108 due to a billing error. I have this credit letter too. I called them last May and the person couldn't see the problem but my account was closed and fully paid, and they didn't owe me £108 sadly!

I had a call a couple of weeks ago from Southern water... It was a an automated message that left me a voice mail. I never contacted them because I don't have an account.

But now Moorcroft are calling me. How likely is this to be related? We bought a house literally today- we were with the developer when they called. Out AIP is done, we just need to do the full application. Will this affect it?

I strongly believe I owe nothing and I have lots of evidence to prove it. I've received no other correspondence other than one voicemail from Southern Water.

Someone reassure me!

Can Moorcroft attempt to collect money which I don't believe I owe?

  • I would strongly suggest getting a copy of your credit file asap as from what you've said there is a high chance that you'll have a default registered.

    If you do, don't panic.

Assuming the default is there I'd say there's two courses of action:

    1) Complain to Southern Water and get the default removed
    2) Get specialist advice and use a lender that will accept an application with adverse credit

    Good luck.

  • I'm 100% sure there is no default. My credit rating from all three agencies is absolutely fine and there is definitely no default showing.

remember , just like parking cases , a DEBT collecting Co , cannot take you to court , only the person/company that you owe the money to.

from memory moorcrofts are only debt collectors , and don,t "buy" debts.

if the debt is "sold" then you should receive s letter from the original company , and the new owners (notice of assignment)

Moorcrofts can "huff and puff" and threaten to kill your pet puppy , but until the debt is sold to them they are just sending threatening letters

  • I firmly believe I do not owe any money, and I have nothing in writing to tell me otherwise.

I assume that I would need to be sent letters by the company before they can give my details to a debt collector?

I would not hesitate at paying the debt if it was proven that I owe it- but I have the final bill, the confirmation saying I've paid it and my bank statement showing they've taken the money.

I have not been informed of any other monies owed, unless they sent it to the wrong address. They have NY current address, so this shouldn't have happened.

what makes you think they have your new address , if you do not have an account with them?

  • The letter they sent was a credit to my account which was done in error. Prior to sending this letter to my old address, they had written to me at my new address with my final bill, which I paid immediately. This took into account actual meter readings rather than estimated readings. since the credit letter, there have been no other letters asking for any money to either my new address or my old address. I've checked with the Tennant and landlord.

You are asking lots of questions of people on a forum that cannot answer them. The best that can be offered is a guess based on the information you have provided.

Why do you not want to speak with Moorcroft? They are the only ones that can answer your questions and, if you believe there is not debt, there is not issue. It wouldn't be the first time a DCA made a mistake.

I suggest you call them and resolve the issue.

Or call Southern Water, if they haven't sold the debt they will happily discuss it. You need to just go to the source, forget checking this file or that report or asking people on a random forum, Southern Water have some kind of outstanding issue, is it really worth losing a house over?

Never nice to make those kind of calls, but chances are its for a very small amount, or it could be that hey don't want anything and Moorcroft are chasing on behalf of someone else - rightly or wrongly - they don't just collect for Southern Water. It could be a mistake, it could be a small amount that can be cleared up easily but either way make the call :)
  • Wait for Moorcroft to ring back or they'll probably write to you. The letter should explain why they are contacting you or they will tell you about it on the phone if its you they are looking for.

Once you know what its all about then you can get advice on the best way to deal with this.

ask the water people and ignore Moorcroft. It could be a genuine error on their behalf.
