G24 pcn

Hello Everyone,

I have read numerous of your forum threads after accidentally finding them when I was looking for contact details for G24, with no success!

I had overstayed 20 minutes in a car park, which I didn't realise, or even notice the signs. I park here regular and I'm sure I have parked there previous for longer than the time, which I'm now aware of, without any penalties.

The only letter I received was a final parking charge notice at the end of December, when the incident occurred at the beginning of November! During the time this was happening I was in the middle of relocating and was at the address very rarely where the letter was delivered to and only got the 1 letter when I returned to that address on the 5th Jan. I wrote immediately, after opening the letter, to G24 in a letter explaining all of this, they then rejected my claims saying £90 is payable immediately and will send debt collectors if I fail to do so!

I am going into the store tomorrow to complain and hopefully get the charge cancelled and I was wondering if anyone can give me some legal jargon I can say about the situation as to why I'm NOT pay it, and how it is not enforceable, so I can prepare myself and sound confident to them that I know what I'm talking about.

I would really appreciate your help!

    If they really threatened to send in debt collectors, then either post up a redacted copy of that letter or quote EXACTLY, WORD FOR WORD the paragraph. sentence that says that they will send in debt collectors.

    "the full value of £90.00 is now due and owing"

    "If, after 28 days, the park charge notice is not paid we will take further steps to recover the amount owed by forwarding the outstanding amount to a debt recovering agency. Additional charges may arise if we have to do so"

    Is this normal? Are they going to send debt collectors to the house or is this just to scare?

    Please read post #4 of the NEWBIES thread. We are talking about some tedious letters already done to death on the forum thousands of times. No they can't send anyone round. Please read the relevant section of the NEWBIES thread so you know which letters to expect but please, no update about each letter. The advice will not change: 'ignore'.

    What happened when you complained to the Store Manager or car park owner/site agents? Done that yet? Why not? You are a customer harassed for money by a scam firm. Complain, like Blodwyn did here:

    I just don't really know what to say and don't want to turn up and just say i'm not paying it without it having any substance.

    I have read numerous of the threads on here but I don't actually understand how their fee is unenforceable and why I don't need to pay it? I know it is hard to fight a cause without having any real knowledge or understanding about it and I don't want to go in, sound stupid and for them to say I still need to pay it or they aren't cancelling it.

    Also I'm very angry about it, so I'm not sure what approach to go in with, try to be nice and get it cancelled or go in how I'm actually feeling, SUPER ANGRY. - I think with super angry I need to know what I'm talking about and I feel like I don't! Any Advice?

    what store was it ?

    did you buy anything?

    do you go there often?

    do you have receipts?

    was the sign clear or prominent?

    does the store want genuine customers scammed?

    how many family / friends / colleagues / go there ..... nut not after you tell them what happens .......

    re read the newbies thread .... it does take a couple of time for it to sink in .. ;)

    hint .... look for the how to complain bit ;)

    did you buy anything? Not on this occasion

    do you go there often? Yes regularly, not only to this particular branch.

    do you have receipts? again, not on this occasion.

    was the sign clear or prominent? not prominent enough that I noticed! maybe had my blinkers on, I'm going to double check when I go tomorrow. Also I can't remember where about I was parked on this occasion which is annoying!

    does the store want genuine customers scammed? Nope, I'm guessing!

    how many family / friends / colleagues / go there ... We have relocated away from our family friends! so none at this particular branch, but other branches!

    work out how much you recon you spend a year there ........

    But you have receipts from other occasions and you won't be saying who was driving when you complain so it's understandable you won't have access to every receipt. You are not going in saying you 'won't pay'. You go in objecting to the entire thing and ask how to get the harassment cancelled because your entire family is angry about being treated this way from a third party trying to extort money.

    If asked for receipts say as the driver that day isn't known for certain you can only show 'these' receipts you have in your wallet to prove you are a genuine customer. Scatter them on the counter then go quiet. When complaining, use the tactic of then GOING QUIET so they have to fill the gap. Bite your lip and just look at them calmly (not aggressively) but assertively, and dress smartly. Act confidently.

    Also the driver may have been a customer browsing, that's still a valid customer, now potentially driven away by this scam. It's the charge you are complaining about, the harassment.

    Please see the 'successful complaints' link which is one of the first things in the NEWBIES thread. Loads of unsure people have 'gone for the assertive complaint' shaped themselves up with a clear, calm plan of action and walked into various retailers and got a PCN cancelled.

    ONLY talk to the Store Manager, not the random person on the desk.

  • Hello,

    So I went to B&M bargains today and explained everything in my first post.

    They said the couldn't do anything about it and gave me the customer service number for G24.

    I called them, fought my cause to which they responded I must appeal in writing (which I already have). They said that they had sent 2 letters to me - which I only received a final notice. I was in the car park as I was talking to them and videoed that nothing around me from where i was parked showed the "contract" .. which they denied saying the car park met regulations.

    So I'm home now starting to write my second letter to them.
