  • The five tests of homelessness
    1 eligibility is British citizen or someone who is entitled to have recourse to public funds
    2 actually homeless or likely to lose your home within 28 days
    3 must have a local connection to the place where you are applying
    4 intentionality is you mustn't have done anything or failed to do something which has caused you to lose your home
    5 vulnerability, eg have dependent children or serious health condition

    You have to tick all these boxes to be statutorily homeless and for the local authority to have a duty of care. Otherwise you are deemed to be non- statutory homeless and not entitled to the same level of assistance.
