  • Hi everyone I really need advice. I ended up in hospital and didn't get to post my s21 on the day I wanted to. I'm sat amending the dates now and because it'll be going tomorrow and they probably won't receive it until Monday, I was going to state I needed possession after the 19th to make sure I've given full two months notice. However some sites are suggesting this is wrong and that I should be requesting possesion on the 2nd April because my tenants pay on the 3rd of the month.

    Is this right?

    It used to be 2 rent periods I think and had to coincide with the contract start/ end date so rent period to rent period but I think it has changed recently/ case law has moved on.
    Gm has posted a link a few posts ago (poat 27). On how to end/ renew a tenancy and it will be in there whether it has to match rent periods etc.

  • DancingFairy thank you for reminding me. I forgot about the link above, I'm all over the place atm. It's so difficult understanding whats right and what's not. I think I'm ok doing it the way I suggested if I send a 21b so I need to check if I need to add anything to my letter.

    It is now too late to sell to a BTL investor when you have not served notice and they are very unlikely to buy the property before the April deadline for the 3% extra stamp duty.
    You need to decide if you want to keep the property or sell and evict your tenants.
    The place really needs to be empty before you sell

    Actually, an investor could buy with the tenants in-situ, and become their new LL. It might put some investors off if they want complete control over who they have in their property. But these sound like OK tenants.

  • They're ok. But they dont keep the house clean and various things have had to be replaced since they've been there. Never had that problem with previous tenants so given everything else I have going on I've had enough and want my money out of the property
