    Certainly the OP needs to dig to find out whether the Insurers failed to advise about the need to send in the CBT and also the cancellation of the policy. If the Insurers made a mistake, they have a case.

    Pointless debate. The OP needs to come back to provide more info.

    I can see the point on CAG, that the OP has landed in a horrible position and perhaps the Insurers could look at it. It is a question as to whether there is a legal remedy or not. The policy had already been cancelled when the accident took place.

    Never been comfortable with Insurers processes in cancelling policies due to not receiving documents. Most don't send any reminder of document not being received and simply cancel with the 7 days notice. If the OP had been a high net worth client of an Insurers, they would have phoned him and sent a letter if necessary, reminding him the CBT had not been received. It is whether Insurers should have to do more and not simply cancel. This is where CAG is coming from, believing a policyholder having paid the full annual premium, should expect to be treated better in the situation, they have found themselves in.

    It would be interesting whether a court would require an Insurers to reinstate Insurance and deal with a claim or accept that Insurers had followed a reasonable process leading to the cancellation. Given that this happened over the Christmas/new year period, perhaps they should have allowed more time in regard to notice of cancellation.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    Some insurers do not seem to know their own systems and timeframes either. I swapped insurers a couple of years back and they asked for a copy of my licence etc. They said you get 28 days to submit them. Within 7 days i had a letter chasing them up, I phoned them and they had received them but the letter crossed. No answer to why i was told 28 days and them chasing it within 7.

    The tread got up to three pages long we TSX and myself explaining the new law and then being told the law does not say that.

    Today they've reduced it down to one page, deleted all of my explainations, deleted all the posts from the site team member disputing how the Consumer Insurance Act works (Even though he seemed to be unaware of it's existence the day before)
