Carphone warehouse vs O2 Mobile

I will try to keep this brief and to the point guys but its been ongoing over 6 months...

Basically, Im in a pay monthly contract taken out via the carphone warehouse (CPWH) and network is O2. Im 16 months into my 24 month sentence as its become. I have frequent network fault connections with no,poor signal, broken calls and cutting out. Ive had my original handset in for repair twice with carphone warehouse - second time it was replaced for a gold one and not the limited edition pink without my knowledge. The faults continued so O2 decided to send me a new phone out direct from themselves...Yet still the faults remain and are not localised to my address. So now they want to send me...another phone, this will be my 4th handset in under 6 months...

Im naffed off to put it bluntly.

I have said i want to be released from my contract without penalty or have my contract costs significantly lowered since im not able to use the services i pay for until my contract term is up....O2 said they cant help, nothing to do with them and to speak to carphone warehouse....Whom im certain when I do I will be passed around again....

Can anyone tell me what im to do? Ive been through every dept and tech team for O2 and still no progress and now they want to pass me off to CPWH...Can they do that even though O2 themselves sent the last phone out to me? There attitude is basically tough, pay up and shut up.

I need some help please...:(

    If the phone is faulty, CPW (not O2) must repair it or replace with identical or better one.
    If they fail or refuse, you can sue them for the cost of a working replacement.
    The fact that the last phone was supplied by O2, not CPW, complicates things if CPW know this.

    Cancelling a contract without fees in practice will be very difficult, if not impossible.
