The car the garage provided was almost certainly a Credit Hire.
If the claim loses in court and assuming it's a Credit Repair, then it depends on what it says in the credit agreement she's signed. Some will make her responsible but most won't and will swallow the costs.
Seems a strange way to operate. So you could have a crash when you are at fault have it put in the hands of a credit hire company who will effectively swallow the loss. Obviously you would need to be economical with the truth but as it seems a simple it's not my fault is all they need.0 -

They only accept non fault claims and where they're clear cut eg hit in rear or as in OP's case where there's a witness.
If you miss lead them, they hold the right to pursue you for their entire costs0 -
I am so sorry at my lack of knowledge, I have been passed from pillar to post so not sure on what has been happening.
The latest from my solicitor is that court proceedings have been issued, and I have to wait to hear on what happens next.
The best person to speak to for advice on how long it will take is your solicitor.
These things are not quick especially when there are injuries and even more so when you're claiming for loss of earnings.
They have a habit of not reaching court0 -
Ok guys so I have an update. True solicitors are representing me and court proceedings have been issued. Today I received this email -
We have not yet received a Defence from the other side's representative. When have therefore, requested the Court enter judgement in your favour. I will further update you in due course.
Does anyone know what the chances are of this being awarded in my favor? It has now been 1 month with no defence submitted from the otherside.0 -
When our car was damaged by a lorry pulling in too soon in front of us our insurance paid for the repairs less the policy excess which we had to pay.
The car hire was dealt with by a claims company who took out insurance to pay my excess after 12 months if the other party hadn't paid it.
The company who owned the lorry would not advise their insurance company about the accident so their insurance wouldn't pay for anything. (The lorry company had advised my insurance company of their insurance details.)
The claims company asked for my out of pocket expenses including my excess but I only had the excess to claim.
As it turned out the excess was paid direct by the claims company insurance and the claims company took the matter to court. They also advised that they were asking my insurance company if they wanted to add any claim.
The last I heard was that the court had issued a warrant against the lorry company for payment.
This was approx 18 months after the event.0
