Or give it to a homeless man/woman on the street, take all the labels out of it or any mention of the maker.

    Job done.

It would keep the homeless person warm! I like it.

I brought a North Face jacket from eBay for £100 and found there was a spelling mistake on the label. Plus on the zip the plastic thing broken off the same day I got it.

So I contacted the seller which he defended himself saying its genuine and we have sent paperwork to eBay and PayPal. He says that send the item back and I will refund you.

I wanted to open a dispute so it gets logged to eBay and PayPal that he sells counterfeit items, so he just gives me a full refund and the dispute is closed. Now he wants me to send the item back, saying its theft if I keep it.

Should I take it to a North Face shop and get a report?
Is it really theft because if I send it back he will just sell it to another customer.
You seem to "bring" a number of dodgy things from ebay -https://forums.moneysavingexpert.com/discussion/5385544or was that bought them. ;)

He wouldn't have any paperwork to send to eBay-it's fake. Don't send it back.
You'd just be perpetuating his scam. I had a similar issue with someone on eBay who even tried to bribe me -and con me into sending it back. eBay eventually closed down their account.
Let eBay deal with it and block him.

Dont send it back. Just tell them that you sent the jacket along with his ebay details to trading standards. Dont let him try to scam someone else.

I thought ebay/paypal normally instruct the counterfeit goods to be destroyed. There was the classic case of a £4,000 antique violin (not a fake) that was ordered to be destroyed because the buyer suspected it was a fake, and the clowns at ebay/papal took his word for it.

Just sent the seller the snippet of ebays T&C's regarding counterfeit goods, and say the item has now been destroyed. You've already had your refund, so theirs no recourse on you. The seller is just trying his luck.

But he said return the item? Do I have to? because I found this in eBay rules:

    Counterfeit items
If a buyer suspects that an item is counterfeit and there are strong indicators that the item is counterfeit, the buyer isn’t required to return the item to the seller. The buyer agrees to cooperate with us to ensure the proper disposal of the item. In such cases, we refund the buyer for the full cost of the item and original postage, and the seller reimburses us for the refund. The buyer may not sell the item on eBay or elsewhere.

The buyer agrees to cooperate with us to ensure the proper disposal of the item

So contact ebay and advise them. That way he may be stopped from selling in ebay. If you don't tell them he can continue to sell on ebay.
