Counterfeit North Face Jacket

I brought a North Face jacket from eBay for £100 and found there was a spelling mistake on the label. Plus on the zip the plastic thing broken off the same day I got it.
So I contacted the seller which he defended himself saying its genuine and we have sent paperwork to eBay and PayPal. He says that send the item back and I will refund you.
I wanted to open a dispute so it gets logged to eBay and PayPal that he sells counterfeit items, so he just gives me a full refund and the dispute is closed. Now he wants me to send the item back, saying its theft if I keep it.
Should I take it to a North Face shop and get a report?
Is it really theft because if I send it back he will just sell it to another customer.

If it's counterfeit and you involve eBay I don't think you'll be allowed to send it back. There's some law about sending such item in the post.0

First of all report it to Paypal. They will guide you.

I did open a dispute, but then he gave me a full refund which closed the dispute.0

Sending counterfeit goods through the post in the UK is perfectly legal unless it's stamps or currency that are being sent.
It's different when sending to many countries outside of the UK, but with internal mail, it's generally not an offence.0 -
But he said return the item? Do I have to? because I found this in eBay rules:
Counterfeit items
If a buyer suspects that an item is counterfeit and there are strong indicators that the item is counterfeit, the buyer isn’t required to return the item to the seller. The buyer agrees to cooperate with us to ensure the proper disposal of the item. In such cases, we refund the buyer for the full cost of the item and original postage, and the seller reimburses us for the refund. The buyer may not sell the item on eBay or elsewhere.
