No that's isn't correct. My father recently bought a new van and he taxed it online on his mobile before he drove it from the guys house. Under the new rules a change of ownership means the car has to be taxed by the new owner immediately.

But I'm surprised to see that the DVLA told the OP to wait until the V5C arrives before it should be taxed?.

It is correct. No doubt your father had access to the VC5 or VC5/2 which the OP doesn't

No, they'll TRY to do that, but they have no power to do so because the law says different and they don't have ANY powers to make or vary the law.

That's why they nearly always lose in court, but in order to go that far most people would have to give up holiday or a days wages + travel costs, which wouldn't be far off the "fine" anyway.

What they do is legalised extortion, backed up by corruption in certain "pockets" of govt.

Nope. Both the V62 and the V10 say

If you are not the registered keeper of the vehicle you may not be able to tax until you get a V5C in your name.

It's the same if you want to SORN it.

I recently bought a car and taxed it using the tear-off slip only.

Dealing with a bereavement is a little different from a regular change of keeper/owner.

DVLA have a page here all about what to do:

    https://www.gov.uk/tell-dvla-about-bereavement/overview

You don't need to have the V5C.

It's always best to follow up any telephone conversation with the info in writing and get a free 'proof of posting'.

But you said above you had now taxed it. How did you do that?

Because it now shows as being registered in my name when I got the fine I rang them and they said I could now do it over the phone as I am now showing as the owner despite not having the V5 (it finally arrived today)

Up till the 26th November my mum was still the owner I didn't exist with the DVLA till they transferred it across

Thank you for this but that's exactly what I did I sent the letter and form to the sensitive case work team

I can't see where it says about not needing the V5 to get it taxed though am I going mad?

    From the DVLA site

    If you don’t have a V5C or V5C/2

If you’re the current keeper, you must apply for a new V5C and tax your vehicle at a Post Office. This costs £25 and it can take 4 to 6 weeks to get the new V5C.

If you’re the new keeper, you can’t tax your vehicle without a V5C/2. You’ll need to apply for a new V5C (you can also get the form from the Post Office.) This costs £25 and it can take 4 to 6 weeks to get the new V5C.

So at least they got that right
