lost item

we contacted tesco about an item not arriving 2 days ago via email as the item was not on time.
today we received the item at 9.38 AM signed for.
at 12.36 AM tesco sent us an email saying the item has been lost in transit /tracking number didnt exsist and have sent a replacement out which will arrive tomorrow between 7:00 AM -7:00 PM.
should we keep the item and not say anything or be truthful and tell them.
Are we at fault here and what would happen if we kept the item.
honestly dont know what to do, if i where truthful though i would expect vouchers off food or something for being honest.

You know the answer. And that last sentence is unbelievable.

I didn't do anything morally reprehensible today, any ideas where I can claim my rewards? Tried googling but no joy.
  • why, thousands of people would keep something that expensive, i know the answer is honesty but vouchers off food for something that expensive isnt that bad of a suggestion as a token for being honest.
you didnt answer my question so only helpful posts please.
am i liable or is it in my right to keep it.
  • you guys act like if you found 1000 pounds in the street you would straight take it to police without thinking hmmm maybe i could pay a bit off X,Y and Z.

They can come after you for the return of the item for up to 6 years. As the error is on their part then the item's collection should be at their cost and at no inconvenience to yourself.

Ok, you should contact them to let them know and you should return it. You have no right to the item, you said it had been signed for so when tesco find out they will pursue you for the second items cost.

And I'm sure by helpful answers only, you mean ones that state you should keep quiet about it, agreeing with what you want to do.

They may decide to provide a gesture of goodwill, but that is up to them and by no means should be expected.

I went to the shops today and didn't take anything I didn't pay for, should I also be given vouchers? That is pretty much what you are saying.

    You are liable for it.

And you shouldn't need to be paid for being honest.

What if that was a single parents deposit on their flat, or rent payment? Money for a beloved pets operation? A payment for a new wheelchair for a disabled relative?

You never know what is going on in other people's lives, and I find it incredulous that there are so many dishonest people around who are only interested in themselves.

I'm always surprised there are people out there who would not feel guilty about doing that, wondering who the money belonged to and what it was intended for.

You really think you should be rewarded for being honest? Isn't that what you were brought up to do as a matter of course?

Already answered your question as to where you stand legally. And just to note that people have posted on here before where they have been asked to return goods more than a year after the fact, so leaving it hidden in a cupboard before ebaying it in a few months could backfire badly.
  • sorry my fault, didnt read what i wrote and indeed it sounds horrible so for that i am honestly sorry.
Thanks for your responses, i wont be in to collect the item tomorrow so if i leave it with the delivery guy will he keep the item stored until tesco collect it?
