Not my parcel

Does anyone know where I stand in this situation please?

I got a notification from a website i had used in the past saying that my parcel would be delivered tomorrow and click here to track....i was confused as i hadn't ordered anything but went on to track and it was definitely a genuine parcel for me so i arranged to collect it from a pick up point as I wasn't going to be into accept delivery. When I collected it, it had my name & address on so it still appeared to be for me. I opened it but there was no delivery note or any other sort of paperwork explaining it's appearance. As it was from a site i'd used before and one I follow on Facebook I wondered if maybe I'd won a competition (I'm always clicking to enter) but before getting too excited I thought i'd better check, so I emailed them to ask. I got a response a couple of days later saying they would look into it and get back to me. I never heard anything back but a couple of weeks later I got a phone call from them saying that they have a missing parcel and they can see that I collected it. I explained that I had already contacted them but she didn't know anything about that so I told her about it being addressed to me and there not being a delivery note etc. she asked if they could arrange to collect it, obviously i agreed but she couldn't collect at a time when i wasnt at work so asked that i leave it outside. I refused as there is nowwhere to hide it on the front and no access to the rear. I had a day off coming up so told her to arrange collection for then which she did but the carriers didnt turn up. I was getting pretty cheesed off at this point so told her that I can be in for collection evenings and weekends only so the ball is in their court to collect. I've heard nothing since...this has been going on since September! Am I in my rights to keep the parcel or should I just keep it in storage until they eventually get around to collecting it?

    No you cannot keep it.you can however tell them when you'll be available and not have to change your life too much to keep them happy.

    Maybe email them and offer an alternative pick up point, neighbours,relatives or work place if possible... Or ask them to send a pre paid label and you could pop it into the post office... Don't phone them, make sure you emailed them so you have proof of contact if things get a little sticky.
  • I have but they won't collect it from my workplace (don't know my neighbours). It's really heavy, I had to get the man in the shop to put it in my car when I collected it so taking it to the PO isn't a viable option. Like I said in my post, the ball is firmly in their court so it'll just go in the garage until I hear from them again!

    They'll have up to six years to chase you for its return or its value.

    You can shorten this by sending two written notices containing certain information (in a nutshell, your contact details), a list of times/dates you are available (and asking them to contact you in advance to let you know which slot they have picked) and telling them that if they haven't collected by x date (i'd give a month to be on safe side) you will be disposing of the goods.

    If you sell the goods, the money belongs to the retailer (minus reasonable costs incurred from selling it - like advertising if necessary) as does interest accumulated on it. You must also get a fair market value for it and can't sell it for "mates rates" (which is why I would go with the disposal option - much less hassle).

    Write to them and tell them that if they haven't collected the parcel from your address, within the time periods specified by you (be reasonable), with 28 days, that you will consider the item a gift and you will act accordingly.

    Should spur them into action.

    *Note this isn't legally defensible just a course of action to spur them on.

    BTW, what is the item? I see no reason to keep that a secret?

    Why not arrange to have it picked up, from where you collected it?
  • Because it's a 20 mile round trip so call me stubborn but I don't see why I should, it's not my error. 🙂

    Yet you were only too keen to make that journey, when you knew you had not ordered anything.
  • Like I said in my initial post, I thought I may have won a competition. I was also going near there to a meeting anyway hence choosing that collection point.
