They are not allowed to come onto the road

Hi everyone

I need some advice please.

I live on an unadopted road that I share with a small school (the School own the road)

My daughter is a qualified Pilates Teacher, and just recently, a handful of her clients have been coming to our home to take their sessions in an outbuilding in our garden.

The Caretaker (who is grouchy at best) has taken umbridge to this slight increase in traffic coming onto the road, and has approached me saying that he thinks my daughter's clients arn't allowed to enter upon it, and that he may need to speak to the Bursar.

The paragraphs below are what are written in the Title Deeds regarding the right of way ....

The right of way (in common with others) at all times with or without vehicles over the land shown coloured ...... and ..... on the plan.

The right (in common with others) to park private motor vehicles on the part of the retained lane shown coloured .... on the plan.

  • define "slight"? they have small, stupid running children to protect, is he being a jobsworth or is it a series of 20 people for a class each bringing a car every hour?

    Well, I sincerely hope it is going to be as simple as that .... Ive already told him he has no idea what he talking about. He is a proper little JobsWorth!!!
  • Looks as simple as that to me, unless others are defined somewhere else, they are other people who are visiting your house.
    I would ask the jumped up caretaker why he appears to be hanging around outside your home peering in your windows, that should get rid of him.

    Yep, he is a proper little JobsWorth, theres no doubt about that, but his job is to protect the "stupid running children" LOL when they are coming and leaving, and that is probably why he is not happy with the extra traffic.

    There is one client per hour arriving at 9, 10, 11 and noon.

    Have you spoken to the Council regarding the use of your home as a business premises. The school may be trying to deal with the matter without undue fuss at the moment.

    That is a very reasonable number of extra cars using your road.

    I live in an unadopted road myself and hence sympathise with you.

    If there were any restrictions in the number of vehicles you were allowed to have using your ROW to drive up to your house - then your Deeds would say so. But the wording in your Deeds makes it quite plain that you have the right to an unrestricted number of visitors.

    Its none of the caretakers business. He IS being a right little jobsworth.

    Ignore him if possible. If he keeps harassing you about this then tell him the exact wording in your Deeds, followed by telling him the legal interpretation of that wording. "Rinse and repeat" however many times necessary. At some point he will get fed-up with knowing that every time he harasses you you will just say exactly the same couple of phrases you said to him the last time and the time before that etc etc.

    Add the fact that its the caretaker approaching you like this. If it really were the case that anything could be said to you - then surely it would be someone a good bit higher up the pecking order than a caretaker doing this? (ie the head teacher of the school concerned).

    So - basic message is Ignore, Ignore, Ignore.

    that seems entirely reasonable to me FWIW!

    I'd ask the head of the school to address the nuisance being caused by their employee
