Hi just popped on before I go to work, Glad to see that you Can afford your normal payments, you have probably fell behind by not tracking where your money goes, those on here will help you with budgeting when you post your inc / exp.
Bearing in mind that you said you Can meet the normal payments that is very good news! - The law works like this; First, the Abbey littigation team cant take your house off you, that is for a court to decide. You should make your normal payment and SOMETHING off the arrears.
If it were to go to court, the district judge wants to hear " I can meet my normal contractual payments" - without this his hands are tied and possession will be granted.
If he hears you can meet the normal payment then he will want to know how much you can afford towards the arrears. The mort. co. will want arrears cleared in 2 - 3 years, however, following the ' Norgan versus Cheltnam & Gloucster case' the arrears can be cleared over the remaining term of the mortgage.
I know that if it goes to court and you offer contractual plus something off the arrears, the the DJ will grant a 'suspended possession order' and so long as you comply you will keep your house.
Im off to court at 11 am today to do just that for a client - will Pm you as soon as I get chance but may have to be this evening - catch you later !Debt Doctor, Debt caseworker, Citizens' Advice Bureau .
