    Just to show how odd the system is, i have just returned from the US embassy Monday 1st Feb, from an interview (the interview btw is less than 2 minutes !) for a B2 visa as i also have 2 past convictions 16 years ago, both spent under UK law. My visa was granted again for another 10 years without any issues. Yes it cost about £300 in costs but thats the price i pay for past errors.

    Mayby its because i have never entered the US on the old I94 or an ESTA i have always applied for a Visa. As the Embassy website does say anyone with a criminal conviction is advised to apply.

    This is my second 10 year visa, i got my 1st one 3 years after my convictions via post before you had to go to the embassy, it then lapsed for 3 years before i just re-applied as above.

    From what i learnt it does seem to be if you "tick no" no one is ever likely to find out but you then need to keep this up for ever, alternatively come clean , apply for a visa and my experience shows generally your not denied unless its deemed a crime of moral turpitude, which then you need to be recommended for a waiver of eligibility which generally takes about 6 months.

    Personally i couldn't travel with a clear conscience, i'd rather just have a visa or not go, theres plenty of other places to visit if they dont want me.

    To the OP, i can only think that perhaps your "crimes" we're deemed to fall in the category of moral turpitude which would exclude you from the B2 visa and then the only option would be referral for a waiver which does indeed take 6 months or so. Where as mine do not (as confirmed by the consular officer) so make me eligible for B2. Bear in mind neither a visa or an ESTA guarantee entry into the US merely the right to travel !
  • US officials do not have access to British police records, they only have access to Interpol records. However, if they are suspicious of someone on arrival, they can request UK police records.

  • sounds a bit harsh seeing as time frame is years. did they say why? do you mind me asking is it because you'd travelled and not declared before or is it the crime? what did you want the visa for? holiday or work?
  • was this for a holiday? why did they decline because of the theft or because you'd been before and not declared?

    With all the gun toting nutters around USA maybe you are better off not going there - perhaps everyone should take that stance and maybe they will see just how ridiculous they are!

    It's illegal to kill people in the US...

    And while I sympathise with them given the long time frame, I'm not going to cancel my holiday in protest at the US not allowing people with criminal convictions who have previously entered under false representation to enter, and I don't think you'd ever convince others to either! Though if they do decide to appeal I wish them good luck.
