    What CPW decide to do with the phone once they get it back is not your concern.

    @ daytona0 thanks for at least trying to see where i am coming from, to all the other posters who have used the word "ethically" can you all really be that good, can you all say with hand on heart that you have never done or suggested anything that involves bending the rules just a little bit if you can then i guess you will all be queueing for a job at the pearly gates when your time comes along.

    to the op - hope you get to keep the phone that cpw gave you in error but you should contact them, phone them first from your 64gb phone :)
    I too hope the OP's honesty will result in him keeping the phone that was given to him in error and then it will truly become his.

    With a receipt like that if i had got a galext s3 with the imei 123456789 but it was a better version that what it should have been would i legally have to return for the downgrade? to me that would look like they have handed title of the phone imei 123456789 to me contract concluded.

    btw i do actually beleave the op should return the phone to save the poor guy who made the mistake getting into trouble, however i am playing a little "devils advocate" here purly because every poster seems to think its all black or white when IMO there are shades of grey here.

    If you had not been handed an S3 then the contract would not have been fulfilled. Would you have been happy to walk away with an S2, as long as the IMEI was correct?

    This really is a black and white situation.

    OP you should answer their calls and see what they have to say.


    I would of thought they would want to come to some sort of compromise with you as the phone is now second hand and they have to go to the trouble of collecting this one and delivering the correct one to you.


    It would be better for you in your future dealings with them if you reach some agreement.

    He bought a 16gb phone so the contract hasn't been fulfilled. I bet it say 16gb on the receipt.

    The OP is in a strong position to negociate but risks having the phone blocked the way he is going.

    Very simple. You backup the incorrect phone to iTunes and then re-install that back up to new phone. Very quick and easy to do.

    Not quick at all, it can also be very confusing to some people.

    The bottom line is the 64GB phone is now secondhand, the OP will also have to go to the effort of returning to the store.

    So if it was the other way round you buy a 64 or 128 and when you get home it's a 16 you're stuck with it?

    Its remarkably easy. Its pretty much pressing the back up button and then the restore button on the correct handset.

    Dosent matter whether its secondhand or not. Thats for the CPW to deal with and of no concern to the OP.

    Who said he needs to return to the store? CPW might be willing to send a courier to collect and replace. Until the OP gets a conscience and contacts CPW, its just guesswork.
