    Yes I understand that. and I am sure that is what they are saying, but what I don't get is why they were believed over me as there were no witnesses,

    Where on their car was the damage?
    I thought my insurance was suppose to be on my side :(

    Yes, they said something about if the case went to court they wouldn't be able to win it. Again I understand that but surely the other side wouldn't either ( I would have accepted 50/50).

    I was on the phone to them for ages disputing it but it seems they have made there decision and there is nothing I can do about it. Hence why i am on here asking it there is anything that can be done?

    Your insurance will be on the side that costs them the least money unfortunately. If they think it will cost them less to pay out than it will to fight that's what they will do. It's rotten and it stinks but that's insurance, sorry to hear they decided against you.

    At the front, their front light was broken and along the side where my door scraped against the side of their car.

    True I worded that badly. But I would have expected they might have tried to get out of it or ask for 50/50? The other insurance company have got out of it!

    Is there nothing I can do? Surely they have a responsibility to me as I pay them.

    Everyone on here said 50/50 I just don't understand why they can get away with 100% my fault.

    I already have a 100% fault claim this year (that wasn't really my fault either my car was stolen but I understand why it goes that way as the insurance had no one to claim against) I dread to think how much my insurance will be next year :eek:

    You agreed to let them handle the claim as they saw fit when you filled in the claim form.
    Everyone on here said 50/50 I just don't understand why they can get away with 100% my fault.

    Not quite. Everybody said that, everything else being equal, it would probably go 50/50.

    Anyway, what is the actual difference to you between 50/50 and 100%?

    Good point maybe someone could kindly explain that to me.

    As I understand it, I would only have to pay half my excess not the full amount. When I have to declare the claim for future insurance I now have to say I have a 100% fault claim (along with all the costs) rather than 50/50 claim (and only my side of costs)

    I did yes, What can I do in future to avoid being in this situation? How can I tell how much an insurance company is going to fight for me? Am I being really unreasonable thinking they should have fought for 50/50?

    So you was already loading? Thus your door had been open for some time before being hit? This seems harsh.

    Get back on the phone to them and tell them you don't accept their decision and make your voice heard.
