Way back in 2014 my daughter picked up a ticket for parking in a Matalan carpark. A buy a ticket and get it refunded in store carpark.
The advice at the time was to ignore it as neither Smart Parking Ltd or DRP pursue court action. She has now received a "Special Settlement Offer - £69.99" letter from DRP. In the letter they "would like to draw your attention to the landmark decision in the Supreme Court of the United Kingdom date 14th November 2015 Parking Eye Ltd -v- Barry Beavis."
As a gesture of goodwill they are prepared to accept the reduced amount of £69.99 if paid before 31/12/2015. It goes on to say should it not be paid by that date Smart Parking Ltd will issue proceedings against her and a judgement awarded in their favour may effect her ability to obtain credit.
Where to next please.

to sum up you can ignore all debt crawler letters as they are toothless ...
you should never ignore TRUE letter before court action or real court papers ...

Debt Recovery Plus are liars just as they were in 2014, they cannot take you to court, and if the Beavis case made it such a dead cert that you would fail at a court appearance why on earth would a greedy bunch of Muppet buffoons be offering a "special settlement offer".
They are just trawling old live cases at this opportunistic time to put the frighteners on you again.
Though any real court papers issued by the PPC or land owner should be acted up on, you can still ignore the DR+ dimwits, and enjoy Christmas.0 -

it will say words like may , will advise the landowner to, and other beating around the bush phrases
DRP cannot issue court proceedings, so they would tell Smart to do so, although Smart dont try court normally , its all threats and bluster, all p*** and wind
read it properly , see how they hedge their bets by using phrases that imply threats rather than actual specific threats

Umkomaas is quite right, it doesn't use that exact wording.
I have a two of the same letters from old accusations going back well over 2 years.
The line in verbatim is, "If you do not pay by 31/12/2015 and Smart Parking Ltd issue proceedings against you and a judgement is awarded in their favour, it may affect your ability to obtain credit"

There really is no need. We've seen the letter any number of times previously. There is no further help we can give you other than to advise you to ignore their letters. This cannot be won now by any form of appeal to DRP or Smart. Just be alert to any Letter Before Court Claim or real court papers issued by Smart Parking (not DRP).

Let me offer some insight, having dealt with DRP in the past, some points to raise with the people who really can't get their heads around how private parking works in the UK.
1. PCN notices ARE 100% enforceable as decided by the Supreme Court of the UK. This includes In Scotland. (Simply ringing up and saying "I'm not gunny peh it" is not a solution. Being Scottish does not offer exemptions to responsibility.)
2. Parking companies can and do take debtors to court, often in large numbers for defaulting on a PCN. Debt Recovery Plus does not ever take a debtor to court they have no power to do so. Some parking companies don't take court action, some always do. In around ninety percent of cases, the parking company wins.
3. Most parking sites in front of shops and retailers are private land. You actually have no right to park here at all and that's why terms and conditions of parking are put in place and are fully enforceable. The shops don't own the land, and saying you won't shop there anymore because you got a PCN is pointless. It has nothing to do with them.
4. If you "phone the police" because you don't want "harassing" letters from DRP, the police will laugh at you, and so will DRP. There are no police, and the few that are still working since Camoron and Uncle George started the cuts aren't interested in the fact you can't face the music and can't put the puzzle together on how to actually park properly.
5. When you ring DRP and you have three PCNs from the same place, "I didn't know about these" isn't a valid argument, because you did. I have lived in his country my whole life and never had one piece of mail go missing. Your lying.
6. DRP will not hear an appeal, cancel your debt, or take any interest in your circumstances whatsoever. They have no power to do so and they do not "sort it out with the DVLA or the client." By the time it has gotten to debt collection it is very simple: there is no appeal, there is no option, you either pay the balance due, or you seek legal advise as you may be summoned to court. End of.
7. Stop whinging and pay your parking charges. There are hungry debt collectors out there that need your money for their commission so they can go to the pub and laugh at you on your dime. Cheers! ��0
