  • Would the following be acceptable / advisable to send to MIL ? :-

    - MIL Collections has no standing to bring a case.
    - MIL Collections has no capacity to form a contract with myself.

    The afore-mentioned extravagant 'parking charge' is totally baseless but I realise that you have now incurred some nominal postage costs. Equally, I have incurred costs to date, for researching the law and responding to junk mail from Capital 2 Coast and yourselves dressed up to impersonate a parking ticket. It is clear that my costs and yours, at this point, do not exceed £15. Therefore, this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the spurious charge within 35 days without further expense and I will not pursue you for my costs. If you persist then I will charge in full for my time at £18 per hour plus my out-of-pocket expenses and damages for harassment.

  • Hi all,

    Court summons now received ! I had already responded to MIL with a letter along the lines of my not being liable to the original parking company and therefore MIL has no connection to that matter etc etc ..... and also stating that MIL's purchase of an old alleged parking ‘charge’ to instigate legal proceedings falls under champerty and maintenance and is not allowable.

    What should I do next ? Insist that they attend the court hearing ? Or I just complete the forms and send them back to the court ? Do i need to attend ?

    dont insist , they or solisitors paid by them WILL have to show up , its a game of poker , they have now chucked in thier final hand , hoping you would have or will fold now and pay up

    its going to cost them a lot to see your hand , several humdreds of £££ in solisitors fees etc to get a paltry £100

How do they nominate the place, is it likely to be a court close to me so I have to attend ? Any help much appreciated !! :-)

    IMPORTANT - KNOW WHAT YOU MUST DO AND BY WHEN!

    Do not think putting in the defence is your only job. Once allocated to your local court, you will be given a clear date by which YOU MUST file the evidence ('exhibits') and any Witness Statement (i.e. yours, as bargepole says in the above link!).

    Hi all,

    NOT !!!!!!!!!

    its an MCOL from Northampton , not a summons

    read the bargepole post and he tells you its what it says on the tin, not a summons

    you would get a summons in a criminal matter for the criminal courts to deal with , not a civil court , so get up to speed on the correct legal jargon too

    also bear in mind you cannot add extra points in later so you need a good basic defence that covers all points , which could be done online instead of using paper , but it needs to be right and needs to address all the usual MIL claims legal points , so same as in the dozens of similar claims and defences over the last 6 months

    remember, this is no longer about the parking event, its about the fact that MIL have bought an alleged debt from a PPC and have issued a court claim to try to enforce the alleged debt

    the PPC are no longer involved

    read twenty or more similar MIL cases from 2016 to get the gist
