Thank you for all your comments and advice on the NTD will be replying to the appeal letter, using the excellent template given and adding the additional statement at the end. Thank you and if I may will keep you informed
I have informed you that I was not the driver of the vehicle. I am not obliged to disclose the identity of the driver and this does not affect my liability in this matter . As the Notice to Driver affixed to my vehicle does not comply with paragraph 7 of schedule 4 to the POFA you cannot rely on the provisions of the Act and hold me liable as keeper . Either take up the matter with the driver or explain fully how you believe you can .[/QUOTE]0 -

Hi I about to send the greatly appreciated crafted response, on the 56th day after the original incident. I will send it via email and post. Can I just ask the importance of the 56th day ?0

POFA2012 is where the dates come in , an NTK following a windscreen ticket must be sent out and arrive between day 29 and day 56, so day 56 is the deadline for it to appear
sending the response too early gives them time to still get the NTK to you by day 56
so why would you help them by pointing out their errors in good time thereby allowing them to rectify the errors ?
for ANPR cases, its would be day 15 , 14 days after the cameras captured the incident
you need to get up to speed on these issues and the laws0 -
Thanks will re-read this now. Really appreciate the guidance on here, but I realise knowledge is power to be able to advocate for yourself.0

If you want to take this further, either with the retailer or at an IPC appeal, post 111 of this thread may help. The OP in that case got the parking charge cancelled.
