    I believe the onus is still on you to confirm with the seller what to have done with the first buggy. By all means if they agreed to you disposing it, then that's fine. But by the sounds of it, you've disposed of their property without any agreement.

    They may now charge you for an additional buggy, before offering a replacement from their supplier.

    jen3711, several posters have asked how you disposed of the first buggy. Others have asked if you can retrieve it.

    You seem to have missed these questions.

    Did you sell the first buggy?
  • No wealdroam I haven't sold the buggy. It is unusable as it collapses when pushed. It is at the local recycling centre with both the huge boxes each buggy came in

    They should of stipulated at the time what they wanted you to do with the first one, but at the same time you should of asked.
    It was obviously an oversight on their behalf but as they know they will not get a credit from the manufacturer without the item being returned they would of contacted you anyway. You could now struggle to get a refund.... What retailer did you buy from?

    Just quoting your post from the duplicate thread when I asked if you had it in writing to dispose of the other buggy.

    If the seller did not give permission for it to be disposed of, then it is not yours to dispose of. You have a duty of care to look after it.

    The seller was very kind sending another out, as many will wait for the first back before sending another.

    You needed to ask the seller to arrange collection of the faulty one, or ask what they wanted you to do with it. Asking for photos is not telling you to chuck it.

    the faulty buggy probably has a simple fix, so it will be cost effective for th seller to collect it.

    Fingers crossed you can find it, otherwise you will need to pay for both.

  • Just to update. I have been back to the recycling point but cant find the buggy, a very helpful man helped me look to no avail. So I've called the seller to explain the situation and he said he should have arranged collection for original buggy and accepts I have thrown it away. He no longer has stock of the buggy so he said I can either keep the one I have or return for a full refund. Thanks for all the advice. I'll make sure I don't throw things away again. Although after buying things on the Internet for the last 5 years I have never once had a faulty item or had to send things back. (Luck I guess)
