Mobile phone advice needed!

Hi everyone.

For about 2 weeks now, my iPhone 5C has been displaying a bug that affects the time on my phone. The phone will not keep to any time, it means I can't set any alarms or use any time or date-orientated apps and it even goes backwards in time some times!

This has frustrated me so I have just been to the Apple Store. My appointment with the genius discovered ( something which I already knew) was that it was a manufacturing problem on some iPhone 5c's. But because it's out of warranty, I was told I'd have to pay for a new phone.

From there, I went to the EE store - with whom I received the phone and have a 24 month contract (4 months left) and spoke to the store manager. I was told they wouldn't do anything because apple only covers the warranty for 1 year. I refused to accept that and they offered me an early upgrade for 'free', on a contract that would cost me £5 extra each month - (but a quick look online and I found the same contract for them £5 cheaper!)

I just want my phone fixed because it sounds silly, but I'm not even able to set an alarm for work, and any texts or messages come through with random time stamps, so I don't know if it wasn't sent a minute ago or 5 hours ago?

Do any of you lovely people have any ideas or advice for me? I'm not sure what to do right now!

    If you have proof of the manufacturing fault from Apple, EE have to repair or replace it.

    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    Next time, if you want a proper 24 months' warranty instead of pathetic 12 months, buy iPhone directly from Apple or pay through the nose for Apple Care.

    That said, EE typically fobbed you off as their obligations under SoGA have nothing to do with Apple's pathetic warranty. However, the only way to enforce your rights is to threaten EE with legal actions and even take the actions if needed. As your phone is more than 6 months old, you need to prove that it's manufacturing fault, not a result of damage/misuse. You should have asked the 'genius' to put his findings in writing.

    With this proof your next step is a letter before action to EE giving them, say, 10 days to repair or replace the phone before you submit a claim to Small Claims Court (online).

    P.S. don't waste time on useless Trading Standards, but CAB can probably help with the LBA, although you can DIY.

    My iPhone 6 is playing up with a couple of issues I bought this direct from apple brand new about 14 months ago.
    Have can I enforce this 24 months warranty as I understood it the phone is only covered for 12 months

    Sure you can, but normally you don't need to "enforce" it with Apple as in practice they voluntarily extend it to 24 months to comply with SoGA (not exactly 'to comply' as it's up to 6 years under SoGA).
