  • Thank you about that Dennis i was a mistake and thank you for pointing it out :). After talking with you all i do feel better and as you say they have basically admitted this in there letter. Do you think the letter i put up is ok to send? I would love it if they would just back down. Thank you all again!

  • Hello everyone just a quick update and would like some help again. I submitted my defence to the courts on the 21st December and I rang the courts today and they said it is now stayed as they haven't received anything from Lowell/Cohen Cramer nor have I as a matter of fact.

    What I'd like to know is what does stayed mean? I've a feeling they will still go for ccj. Also what would be my next steps as I want to fight the default as I'm sure it's wrong, I want to improve my credit as I would like to get a mortgage in the future, so any help will be very much appreciated as always. Thank you to sourcrates and everybody else who gave me some tips thank you!! :)

    It just means the case is on hold until they here from Lowell, you will just have to wait and see what there next move is.

    As they appear to of admitted previously it's statute barred, there only other legal argument was the flawed information about the default date been the cause of action date, which was utter rubbish.

    I suspect they will discontinue, but will probebly make you sweat a while longer before telling you.

  • Sourcrates thanks again for all you do! I hope they discontinue but my dad just rang to say that lowells sent me a letter to say that they have changed solicitors to there own one so looks like they will continue the ccj? They really are a piece of work!

    Or the other solicitor saw that it was a waste of time and they were in the wrong and Lowell have no choice but to change and try again? Hold tight the advice above is brilliant. And it shouldn't be a CCJ, I believe a judgement is only issued when you ignore and don't respond etc.

    You have had fantastic advice already, I just wanted to add to those saying don't panic! They lost round one, I should think they are hoping you may sweat and break, just stand your ground and continue as you have done, I can't see how they have a case. These solicitors are not the most expensive and best in the land, they will be bulk processing claims hoping some stick, the fact they can't even get the year right in a letter to you kind of backs that up.

    Just keep doing what you've been doing :)

    If they go to court and try to convince a judge that the default date in this case, is the same as the cause of action date, they will be laughed out of court, trust me, I think you will be ok !!!
