eBay Buyer has opened INR, Hermes shows parcel delivered

  • Do eBay's promotional messages count as advertising? If so, I think there would be a very good case for complaining to the Advertising Standards Authority about their "promise" that a customer who does not receive their goods will get a refund, when eBay's policies not only fail to ensure that this is the case but actively discourage it.

Statistical analysis wil also show that most not recieved claims are false. This is why there is a special tick box on Royal Mail claim forms for Ebay....

If the tracking shows as Delivered, I cannot see how Ebay can decide any other outcome. Ebay could of course fund this themselves, but they tend to only issue refunds when the seller funds them. On the balance of probabilities, if the item tracking shows delivered, it has been delivered.

I can't really see a case of false advertising, but why not file this with the ASA? It would be interesting to see the outcome. I certainly think there is a case to be made against Ebay trying to recruit new sellers advertising that selling on Ebay is safe, witb smiley pictures of the seller protection team and that Ebay protects sellers...if it was 'safe' we wouldn't see so many chargeback threads here..

I don't see how statistical analysis could show anything of the sort: in the vast majority of cases there will be no evidence one way or the other.

The seller in my case has left "positive" feedback with a negative comment. Can someone confirm that if I ask for it to be removed, all trace of the feedback will be removed and it won't just say "comment removed by eBay" or something along those lines?

No, the positive will still remain and the text will be replaced as you suggested. The seller will be issued with a feedback abuse slap on the wrist.
  • I just had an INR case opened for a Hermes delivery too. Hermes showed it as delivered so I uploaded the tracking info along with step by step delivery progress info and the buyer has closed the case and left positive feedback.

Do I get any sort of defect for this ?

I had two INR cases closed by buyers after item arrived. Checking my dashboard, two defects listed:(

If that's the case I'll be on to ebay to see if I can get it sorted, how ludicrous to get a defect for nothing

The defect is for the case being opened.

It will go if you escalated the case and won. If the case was closed the defect remains. You can try CS but policy isn't to remove it.

I think Ebay will only remove defects if you upload tracking before any case is opened. I import my listings onto My Hermes from Ebay. Once I pay for the labels it automatically uploads tracking to Ebay and marks them as dispatched.
  • The defect system is changing in February and as far as I understand, I think resolved INR cases afterwards will not count as defects. According to the preview shown when you open the seller dashboard, it appears that any defects already incurred which would not be defects under the new system will disappear after the new rules come into effect, but I suppose we'll have to wait and see whether it works that way in practice.
