Blocked from leaving box junction

Basically I was in a queue of traffic in the left lane, on a two lane one way road. Box junction ahead, so I waited til a car length was free beyond the box to move forward.

However when I was halfway across the box junction a BMW 1 series in the right lane shot past me, and pulled into the space I was heading for. Their lane wasn't clear.

So ended up stuck on the junction. Now there wasn't a camera, but if there was, would I have had a defence?

The HC states that "You MUST NOT enter the box until your exit road or lane is clear"

Your defence would be that the exit was clear when you entered the junction so you have not broken the HC and cannot be held liable for the actions of other drivers.

But it's one of those times when dashcam footage would be very handy in your defence.

I bet every man and his dog comes up with the same story :)

Well if he gets snapped then there will likely be further footage available to back up his claim.

the op is at fault, as the BMW 1 series driver owns the road

OH got caught in similar fashion - his space on other side of box junction (a large one) was clear but as he drove across into it, a car on other side, in left hand lane, two cars ahead, suddenly changed lanes to force its way into a gap opening in front of the car in front of OH. The car in front of OH then stopped to avoid hitting the car forcing in and OH had to stop in turn . At that time the lights ahead on other side of junction then changed to red and OH was left stranded in the box. Photo on traffic camera just showed OH stationary in box and he had to pay up. Appeal not allowed

So the exit wasn't clear when they drove into the box if there was a car in front of them?

I've been overtaken and blocked by a motorbike when entering a box junction. Seems to be all too easy to get trapped in one without intention

Traffic was moving and OH reached edge of box. Car in OHs lane on opposite side of box was moving forward and there was a space opening up behind it opposite OH. OH started across junction to enter this space but car opposite was slow moving and car in left hand lane (on other side of box junction) suddenly changed lanes to force its way into potential gap causing car opposite OH to brake suddenly. OH was already injunction when this happened and had to continue. Ended up on opposite side of junction with end of car stuck out into end of box. This is a very large multi box roundabout in London controlled by lights and a real money spinner!

So again the exit wasn't clear when your OH entered the junction. Not the same as the OP.
