Orange 18 Month Contract

Hi people my girlfriend upgraded her phone with orange 12 months ago, she has rang up today to upgrade again but was told she had agreed to a 18 month contract last year. This was the first she new about it being a 18 month contract as this was not agreed by her verbally or in writing. Needless to say she is a little un-happy, where does she stand ? This was not agreed by her and orange say it was>>>>> Thanks in advance

I would turn it around and ask Orange to show proof that she entered into an 18 month contract. You will need to find a high level complaint contact and give them a time limit to sort the problem out or you will take this to Trading Standards. State that if you incur any losses through this action you will be claiming them back so this is on record and chances are this will shift them. Good luck.

upgraded over the phone, thanks for replys x:T
  • You'll have a hard time arguing your case.

the contract would have been confirmed over the phone (generally) at time of upgrade. if you upgraded directly (ie, called 150) then the info is on the systems in relation to the notes on the account. if upgraded indirectly (through a 3rd party) Orange will request you take the issue up with the 3rd party.

With telesales (dialling up150) you agree verbally to an upgrade. There is no need to sign anything, as you are just agreeing a fixed-term extension to a pre-existing contract.

Your bills would detail your service plan length generally.

    ie) Racoon £30 18month.

If your g/f is on a tariff with direct benefits of an 18month tariff (ie, extra mins, extra texts - where a 12month length would offer less) then contesting the contract may end up in a re-calculation of the previous 12-months bills inline with the fewer allocated mins/sms :|

    Things to check:

    1) Direct or indirect upgrade (If indirect, who is the Dealer)
2)Bills - does it state 18month on or near service plan detail
3)Allocated mins/texts - are these prereferntial to an 18-month contract where a 12month would offer less?
4)Retentions offer/standard upgrade? (retentions offers are usually 18mth, usually provide extra benefits etc.)

that's all i can think of off the top of my head
