  • So we got a letter from the court asking if we wanted to proceed with our counter claim, we didn't have time to write to CEL in between to ask them to pay up. We were only counter claiming for our costs incurred so I called the court to ask for their advice and they said to write a letter with our response explaining the situation and to say that we're happy to proceed however works best for the court in terms of cost claiming. I'm just waiting to hear back from them now.

    In terms of the original fine and court case though this has all been 100% retracted.

    It's angering to think of the amount of people they wrongly wrote to though just before Christmas as I know so many people did pay up. I hope more of them argued it.

    I'm glad you got it retracted and will perhaps get recompense.
    It's a shame an abuse of the judicial process is going on on such a wide scale.

    CEL are a vexatious litigant in their actions, but this has never been confirmed by a judge. (If a judge ever did rule this then it would kill CEL's claims process stone dead - they'd not be able to file any claims until that ruling was retracted [as far as I am aware]).

    You will lose your counter claim if your previous post are accurate.

    You wrote " So armed with our emails and the advice we read from this forum about CEL never turning up to court, we decided to submit a counter claim for costs incurred and costs we will incur for going to court....................................Our counter claim was only to cover the cost of the fee we paid to make the claim (£60) and time and costs for attending court, ."

    You also said that you were planning to defend yourself. So, as you had no costs for attending court as they withdrew, and as Quentin says that the court decides costs anyway, your claim would have been for £0.
