I have now received the N180 /Directions questionnaire in the post.
I have have started to complete it and intend to return it within the allocated time.
Part A1 of the form asks about mediation - Does anyone know if it is worth going down this route. I am a bit cautious as I do not want to show a weakness to the other side.
The Courts look favourably on parties who attempt mediation in order to try and settle the matter without the need for a hearing.
Any attempted mediation cannot be referred to if the matter does go to a hearing, so I wouldn't worry too much about 'showing weakness'.0 -

UKPC have responded to my part 18 request for further information. In summary, with help from [/FONT]IamEmanresu [FONT="]I asked for the following:
[/FONT] [FONT="]1. [/FONT][FONT="]A copy of the full un redacted contract UK Parking Control Ltd had in place at the relevant times with the landowner, agent or occupier.[/FONT]
[FONT="]2.[/FONT][FONT="] Copies of the signs and their location within the site[/FONT]
[FONT="]3.[/FONT][FONT="] Copies of the PCN’s that UK Parking Control say were issued the times claimed[/FONT]
[FONT="]4.[/FONT][FONT="]Time stamped photos of the above.[/FONT][FONT="]
[/FONT]
5. Details of the installation and maintenance regime for the signs at the location
6. Copies of any notices to keeper that UK Parking Control were sent to the registered keeper
In response:
[FONT="]1. [/FONT]They have refused to provide a copy of their contract for reasons of ‘commercially sensitivity’ however, will produce it at the hearing should the court wish to make reference to it…
[FONT="]2. [/FONT]Copies of signage and map locations have been provided – I will need to verify these
[FONT="]3. [/FONT]Copies of all three (3) PCN’s have been provided.
[FONT="]4. [/FONT]Some very grainy, poor quality photos of signs have been provided that were taken in the early hours while it was still dark along with similar quality photos of the vehicle, some of which just have the windscreen and something that resembles a PCN. (NB: x2 PCN’s were issued during the day and 1x PC while it was still dark)
[FONT="]5. [/FONT]They have stated that the signage was installed mid-2012 and is maintained on a ‘ad hoc basis’ But provided no proof..
[FONT="]6. [/FONT]The claim is for three (3) individual PCN’s BUT…the claimant’s solicitors have only provided one (1) NTK.
As explained in my original post, I hadn’t kept any correspondence because I was still following the old advice (to ignore). Recently however, I have actually come across one NTK which happens to be the same one that they have provided. Now it could be a coincidence but the request (above) asked for all of them.
Could it be that they only issued one in the first place and think that I might not notice? Or are they allowed to provide the others (if they do have them) at a later date even though they were requested in my part 18??
Can I please have your thoughts on any of the points above??

You are dealing here with a rogue trader who has already committed fraud by doctoring tickets

As you read this you will come to a part where an ex employee of UKPC refers to "ghost tickets", a practice whereby a ticket is issued, placed on the windscreen, a picture taken and then the ticket removed unknown to the driver. The driver is then unaware of the ticket until he receives a letter demanding money which then maybe too late to appeal.
Could this relate to your 3 tickets ???
In view of the disgusting behaviour that UKPC practices, you should really have a chat with your local Trading Standards.
As the judges of county courts are not up to date, they may or may not know of this rogue trader but certainly calling upon evidence you find on the internet against them will indeed help you and it might stop the rogues proceeding.0 -

There were no other thoughts added yet. He hasn't said if he's got a hearing yet.
If he appealed the PCNs then there will quite likely have been no NTKs. Otherwise, I'd say there were NTKs issued because he says he ignored it all. But if they fail to produce them and he is defending this as keeper, then it's relevant to show how they have failed to prove the provisions of Schedule 4 of the POFA were complied with.

Hi guys
Thanks for thinking of me... I did ignore all the previous correspondence before the first court document however, I just thought it was strange that within my Part 18 request I asked for a copy of the NTK's but and they only sent 1 out of the 3. What made it even more strange was that I've recently found some of the said correspondence which coincidently contained only one NTK - The same one that they sent. I wondered if there was a possibility that they only ever sent 1 NTK for 1 PCN (instead of the 3) in the first place.
By way of an update:
I have now submitted all of the paperwork this far (the last being the N180/directions questionnaire.
They have provided me with a date for mediation (end of Feb) I tried to have it changed to a more convenient time because of work commitments but to no avail. I'll see if I can be available but if not I'll wait for the court date.
I'll let you know when they do send me one, no doubt I'll need your help for my defence0 -
