Paying for Holidays - Bank Transfer

Hello -

Am keen for some advice please: when booking our honeymoon, I have paid by bank transfer to get it over and done with; however am now concerned that in the event of something untoward (weather, terrorism etc) that I will not be able to get a full refund as paying with a credit card would have meant I would have been covered to an extent by Section 75.

I am confused whether this would have applied to a tour operator in any case, who nonetheless is covered by ATOL and we both have comprehensive travel insurance. I am in two minds about ringing the tour operator to change my payment details (if I can) and actually whether it is worth it as I have read that Section 75 does not cover bookings via a travel agent.

Would be grateful for any help or advice anyone can give!

  • Didn't you get the opportunity to pay by card? You would have still got it over and done with.

    If you've booked a package holiday and flights are cancelled because of an FCO advisory against travel then the package will be cancelled and you are entitled to a refund.

    I'm not sure what you mean by weather? If you mean hurricanes, flooding etc then again, if flights are cancelled you are covered if you've booked a package.

    Atol is of no consequence when it comes to cancellations other than when the supplier fails financially. Section 75 mainly covers if there is a fraudulent charge or the goods aren't received, but if it's a package holiday then as before, your tour operator owes you a refund if your holiday is cancelled.

    You mention travel agent and tour operator. Did you book a tour operators package via a travel agent, or did you book direct with the tour operator? Or is the travel agent acting as principal (tour operator)?

    Provided that the transaction was made in accordance with section 75 requirements, it would cover far more than just fraudulent charges and not received claims.


    Section 75 should cover all losses that occur due to any breach of contract by the supplier if that supplier would have been held liable to pay for the breach.

    True, but why would the OP think that a tour operator is going to breach their contract by not refunding if a refund is due?

    Section 75 won't help if the OP is disinclined to travel because of terrorist activity or inclement weather conditions, which is the point I was trying to make. The OP doesn't make it clear what they're really referring to, or how/what they've booked.
