Nearly 4 months and still not paid by Capital One?

Hi,

Turns out we were due nearly another £800 from Capital One. Ha actually forgot about it as we used a claims company who had said they received word from Capital One informing us we may have not had the correct amount paid. So we signed off authorisation and off they went.

However some time passed and then we got a letter around October time or such from the PPI company asking for payment of their service. It had actually gone out our head and sent a letter advising that we had not received anything, even though they had mentioned that we had received a letter from Capital One.

I asked for any evidence of communication and they sent out a letter from Capital One (addressed to them) saying what we were due and that we would receive within 15 days, that was in August.

We then asked the claims team to pursue, although a week or so later we got a call from their accounts team once again requesting payment. I told him I had already been in touch.

Now that was the end of October, and I still to this day heard nothing from either side.

I have sent a letter around 18th November to Capital One asking what was happening.

Should I send a letter to the Claims company also?

I'm wondering also if the interest will rise with the owed money too as it is no another 4 months coming up since they said we would be paid?

Anyone?

  • I suggest you complain to the CMC that they are requesting payment but have failed to discharge their responsibility to pursue the redress from the lender.

    Just an update, sent a letter to the claims company who then a few days later says they will be sending out a chaser letter, not sure what they've been doing then, as this was supposed to happen months ago when I spoke to them when they asked about payment.

    Heard not a peep from Capital One either.

    Although taking into consideration the holiday period, the 15 days is a no-no once again.

    Really starting to lose patience with all concerned here. I'm wondering if I can just ask the claims company to progress with legal proceedings, but wonder if they are thinking well they said they are paying so we'll just wait it out and the bank are thinking, nothing is getting done so we'll just leave it.

    A recent ruling by the CMC regulator means that if the bank says they will pay out more after the initial ruling then the CMC can't claim the money - magpiecottage did a post on it if you look back a couple of weeks and refer the CMC to that ruling and chase Cap One yourself

    Thanks, found it.

    I maybe wrong and will need to look, but I'm sure they sent something out to sign to go ahead with the increased claim amount.

    I'm assuming I must have signed some authorisation again for them to act on our behalf?

    Tbh, the thing from the bank went straight to them, not to us.

    Think I'll be heading to the Legal Ombudsman to raise a complaint.

    I'll send over another last letter, as I think I should be in my right to now request they proceed with legal proceedings against Capital One who are not paying out.

    Never heard anything back from them, although not sure if this is because it seems that all dealings look like have went through my claims company.

    I'm guessing because they have the letter saying we're due this and that, that they don't wish to get messy as basically it's money in their pocket, but aren't particularly bothered when it comes.

    Think it's time to get them to do what they say they actually do and for them to get a bit tougher with CO.

    They won't "proceed with legal proceedings" at all and you can't demand this. You can if you wish (expensively) take the Bank to court, but the time taken will also be well in excess of allowing the Ombudsman to simply chase them.

    Write a letter addressed to the CEO of Capital One and see what that brings..

    Pity that.

    Sure I saw an address for London, as last one was a PO Box therefore couldn't send recorded delivery, but will do this time. Will have to be a MD or other head member for UK, as the CEO is American and guessing he lives there, so can't see the point in sending to him.
